Toques submits the modification of the water tax to public exhibition
Por FactBox Admin

The Plenary of the Toques City Council initially approved, in an extraordinary session on October 28, 2026, the modification of the “Fiscal ordinance regulating the water supply tax”. The agreement is published in the Official Gazette of the Province of A Coruña number 210, dated November 3, 2026, with official reference 2026/7066, and opens a period of thirty business days for interested parties to examine the text and submit claims. The decision directly affects the water bill of all subscribers in the municipality.
The processing is carried out under article 17.1 of Legislative Royal Decree 2/2004, of March 5, which approves the Revised Text of the Law Regulating Local Treasuries. The announcement was signed by the mayor, José Ángel Penas García, in Toques on October 29, 2026, one day after the plenary session, and occupies a single page in the Local Administration section of the provincial gazette.
The essential data of the procedure are as follows:
- Approving body: Plenary of the Toques City Council, in an extraordinary session on October 28, 2026.
- Object: modification of the fiscal ordinance of the water supply tax.
- Publication: BOP of A Coruña number 210, dated November 3, 2026, announcement 2026/7066.
- Exposure period: thirty business days.
- Place of consultation: Municipal Secretariat-Intervention of the council.
Thirty business days to appeal
The public information period is counted from the day following the insertion of the edict in the Official Gazette of the Province, meaning the count begins on November 4, 2026. During this period, interested parties may examine the ordinance at the Municipal Secretariat-Intervention and submit any claims and suggestions they deem appropriate.
This is the mandatory procedure that local treasury legislation reserves for modifications to fiscal ordinances, such that the wording approved by the Plenary is provisional until the appeal period is closed.
Automatic final approval if there are no claims
Once the public exposure period has ended, the Corporation will adopt the appropriate final agreement, resolving the claims submitted and approving the final wording of the ordinance. In the event that no appeal is submitted, the agreement, which until then was provisional, shall be understood as definitively adopted without the need for a new plenary agreement.
This mechanism is common in municipal fiscal ordinances and implies that, without a response from the neighbors, the modification is consolidated with the simple publication of the initial edict.
The bill that will be affected
The water tax in Toques is perceived through the census prepared by the company holding the concession for the home supply service of drinking water, ESPINA & DELFIN, S.L., which the City Council displays periodically. In the announcement published in the BOP on September 18, 2026, corresponding to the second quarter of 2026, the census included the fees for water supply services, the water canon, and the maintenance of meters and connections, with a fifteen-day exhibition period on the municipal notice board.
According to these announcements, payment can be made at the concessionaire’s offices, open to the public on Tuesdays and Fridays, and an appeal for reversal may be filed against the settlement within one month; the water canon allows for an economic-administrative claim before the competent regional body, in accordance with Decree 136/2012. The modification currently on exhibition will therefore apply to quarterly billing that has already been determined by those censuses.
In a context of municipal account adjustment
The review of the tax occurs at a time of fiscal reorganization in the City Council of Toques. The Plenary, in an ordinary session on October 5, 2026, initially approved a budget modification file through a credit supplement charged to the treasury surplus, subject to fifteen days of public information in the BOP on October 13, 2026.
The coincidence of both files places municipal tax policy at the center of local current affairs, although the water tax edict does not detail the amount of the tariffs nor the specific nature of the modification, which must be consulted in the text deposited at the Municipal Secretariat-Intervention.
For the residents of Toques, this procedure is the only window to influence a bill they will pay every quarter: those who have objections regarding the new yield have thirty business days from November 4 to submit them in writing, and their absence will make the amount approved on October 28 final.
