Talarrubias declares the call for two lifeguard positions void
Por FactBox Admin

The Talarrubias City Council has declared the selection process convened to fill two permanent seasonal lifeguard positions, vacant in the municipal staff, as concluded and void after no applicants passed the tests. The decision is formalized through a Mayoral resolution and published in the Official Gazette of the Province of Badajoz number 193, dated October 8, 2026, under the reference Announcement 3956/2026.
The affected procedure is file number 999/2025, relating to the call and selection tests for labor personnel via competitive examination. The call was approved by Mayoral resolution number 2026-0014, dated June 30, 2026, and its bases were published in the Official Gazette of the Province of Badajoz number 68, dated April 13, 2026, while the call announcement appeared in the Official State Gazette number 98, dated April 22, 2026.
The convened positions corresponded to group C2, with the status of permanent seasonal labor personnel, a modality linked to the seasonal activity of the municipal swimming pool. As they remain unfilled, the positions stay vacant in the council’s job registry.
A process without eligible applicants
The second section of the resolution justifies the declaration of void based on the absence of candidates who passed the first exercise of the opposition phase, which was eliminatory. In other words, the cutoff occurred in the first test of the process, with none of the present applicants reaching the required level to continue.
With the signing of the resolution, the selection procedure is definitively finalized, without the creation of a job bank or the formalization of any contract derived from this call.
Publication and administrative effects
The third section of the resolution orders the agreement to be publicized in three official formats:
- The Official Gazette of the Province of Badajoz.
- The electronic office of the Talarrubias City Council.
- The notice board of the City Hall.
The resolution ends the administrative route, therefore an appeal may be filed against it under the terms detailed in the announcement itself.
Deadlines and avenues for appeal
The text published in the gazette opens two alternatives for challenge:
- Optional appeal for reversal (recurso de reposición) before the Mayor’s Office of Talarrubias, within one month from the day following its publication in the Official Gazette of the Province of Badajoz, in accordance with articles 123 and 124 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations.
- Contentious-administrative appeal before the Contentious-Administrative Section of the Court of First Instance of Mérida, within two months from the day following the receipt of the notification, according to article 46 of Law 29/1998, of July 13, on Contentious-Administrative Jurisdiction.
- If the optional appeal for reversal is chosen, the contentious-administrative appeal may not be filed until the former has been expressly resolved or has been dismissed by administrative silence.
The resolution appears digitally signed by the mayor, Antonio García Sánchez.
The outcome leaves the municipality with two unfilled seasonal positions linked to the lifeguard service of the municipal pool, which will force the Talarrubias City Council to reopen the selection process or resort to temporary formulas to guarantee surveillance and rescue at the facility during the next swimming season. The case also illustrates the difficulty of attracting qualified candidates to lifeguard positions in rural areas, where qualification requirements and the seasonality of employment reduce the number of applicants.
