Suances abre informaciones previas por presuntas infracciones urbanísticas en Tagle

The Suances City Council has agreed to initiate preliminary inquiries into the alleged commission of urban planning infractions on rural land in Tagle, within the framework of file 2021/879. The decision, adopted by resolution of the Mayor’s Office on September 18, 2026, is published in the Official Gazette of Cantabria (BOC) no. 188, dated September 30, 2026, with reference CVE-2026-7531. The procedure is in response to a complaint by Ecologistas en Acción and affects a group of 14 cadastral plots.

The resolution is based on Article 55 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations, which enables the Administration to open a preliminary inquiry phase before deciding whether to proceed with public urban planning action. The stated objective is to clarify the background surrounding each of the reported situations.

According to the announcement, this preliminary inquiry is justified by the differing nature of the detected facts, the time elapsed since their alleged commission—with eventual statute of limitations as a determining factor—, the different locations, and the possible attribution of responsibility to different subjects.

Fourteen cadastral plots under investigation

The file identifies the group of cadastral plots under investigation, with references from two different series:

The announcement specifies that the purpose is to clarify, prior to any possible prosecution of public urban planning action, the background of each situation subject to the complaint.

Four interested parties not located and one month to appear

Having carried out the notification of official letters to those considered interested parties, in accordance with Article 44 of Law 39/2015, the City Council makes public that notifications could not be served to:

  • Ms. Estela Castillo de la Torre
  • Mr. Enrique Ruiz Arranz
  • Mr. Rafael Ortiz García
  • Mr. Álvaro Gil Canales

Said interested parties are summoned to appear at the offices of the Suances City Council, located at Pl. Viares 1, 39340, Suances (Cantabria), Monday to Friday during public office hours from 09:00 to 14:00, within a period of one month starting from the date of publication. If this period expires without appearance, the notification shall be deemed produced for all legal purposes from the day following the expiration date, with the subsequent continuation of proceedings. Simultaneously, an announcement is sent to the Single Edict Board (TEU).

Procedure without appeal, but with a channel for allegations

No appeal may be filed against the issuance of official notices, given their nature as a mere formality that does not directly or indirectly decide the merits of the matter. Nevertheless, opposition may be alleged by the interested parties for consideration in the resolution that terminates the procedure, in accordance with Article 112 of Law 39/2015, without prejudice to appeals based on the grounds of nullity or voidability provided for in Articles 47 and 48 of the same regulation.

The announcement was signed in Suances on September 18, 2026, by the mayor, Andrés Ruiz Moya.

The opening of this file places Tagle in the focus of municipal urban planning surveillance and opens a formal channel for the owners of the indicated plots to provide information, submit allegations, or communicate changes in ownership data. The outcome of the investigation will determine whether public urban planning action is exercised and whether liabilities are established for the allegedly irregular constructions or uses on rural land.
