Judgment corrects the Markets Officer pool in Melilla

The Ministry of the Presidency, Public Administration and Equality of the Autonomous City of Melilla has published in the Official Gazette of Melilla (BOME) number 6406, of 18 August 2026, Order 3813, of 13 August 2026, which modifies the job pool in the category of Markets/Slaughterhouse Officer. The resolution responds to the ruling of the judgment handed down in the abbreviated proceedings 58/2025, which partially upheld the administrative appeal filed by an applicant identified as Ms. C.M.M.
The order adapts Order 1841, of 11 April 2025, which originally constituted the job pool for the provision of 5 posts of Markets/Slaughterhouse Officer. The Selection Board of the selection process met in session on 9 July 2026 to agree on the changes arising from the judgment, taking into account file 12039/2023.
Reordering of scores
The resolution establishes a new classification of applicants, with the scores obtained in the two exercises of the selection process. The list includes 83 applicants in the general quota and 11 applicants in the quota for persons with disabilities, totalling 94 candidates affected by the modification.
The first three positions in the general pool are occupied by:
- Luis Jiménez García, with 17.70 points (8.30 in the first exercise and 9.40 in the second)
- Mohamed Amar Achor, with 17.00 points (8.80 and 8.20)
- Ignacio Jesús Pérez Ruiz, with 17.00 points (10.00 and 7.00)
In the disability quota, the first position goes to Fatiha Abdelkader Buyemaa, with 14.90 points (7.30 and 7.60).
Tie-breaking criteria
The order specifies that ties have been resolved in accordance with Article 9 of the Terms of the call for the constitution of job pools for temporary contracts and appointment of interim civil servants of the Autonomous City of Melilla. According to this provision, if the tie persists, the letter V is applied as the final criterion, in accordance with Resolution of 25 July 2024 of the Secretary of State for Civil Service, published in BOE number 184, of 31 July 2024.
With the publication of this new order, the previous job pools for Markets/Slaughterhouse Officer are repealed, with only the modified version remaining in force.
Appeals and deadlines
Against Order 3813, which does not exhaust the administrative route, interested parties may file an appeal for reconsideration within one month from the day following its publication or notification. Said appeal may be submitted to the Ministry itself or to the President of the Autonomous City of Melilla, as hierarchical superior. The maximum period for issuing and notifying the resolution is three months.
The resolution was signed on August 13, 2026, by Pilar Cabo León, Technical Secretary of the Presidency and Equality of the Autonomous City of Melilla.
The ruling in the abbreviated proceedings 58/2025 sets a relevant precedent for public employee selection processes in Melilla, by confirming that administrative decisions regarding job pools are subject to judicial review when violations in their formation are proven. The 94 affected applicants will see their chances of accessing a permanent position in the municipal markets and slaughterhouse redefined.
