The Department of Security has announced the penalties for citizen security

The Department of Security of the Basque Government has announced six resolutions in the Official Gazette of the Basque Country (BOPV), regarding infringements of Organic Law 4/2015 (on the protection of citizens’ security). The notification was made by the Directorate for Security Coordination, after individual notification proved futile, and was published in the issue of August 25, 2026, under reference 2026/3696.

Legal basis of the notification

The resolutions were published based on Article 44 of Law 39/2015, regarding the common administrative procedure, which provides for notification by advertisement when personal notification fails. According to the document, the notifications will be published in the Official State Gazette (BOE) and will take effect from the following day.

To examine the file, interested parties may visit the Directorate for Security Coordination located at Larrauri Mendotxe Bidea, 18 in Erandio. The document was signed in Erandio on August 20, 2026, and signed by the director ASIER ERKOREKA ARRUZA.

Six files, all archived

The annex of the advertisement lists the data of six people, each with their file reference, the date of the infringement and the resolution, the imposed penalty, and the violated article. In all cases, the measure imposed is archiving, and the violated articles are 36.16, 37.01, and 37.04 of Organic Law 4/2015.

Articles in the penalty area

Article 36.16 of Organic Law 4/2015 is located within the set of behaviors considered serious infringements, while Article 37 specifies very serious and serious infringements. In this case, all resolutions decided on archiving, meaning no financial penalty was imposed, and the procedure has been closed.

This notification is important for the interested parties, as it is the official means of receiving notice of administrative resolutions, and the deadlines and valid appeals begin as a result of the notification. By publishing the advertisement, the administration has fulfilled its obligation to notify the interested parties, even though individual notification was impossible.
