The Department of Security of the Basque Government has notified 37 sanctioning proceedings through announcement 2026/4169. The notification was published in issue number 193 of the Boletín Oficial del País Vasco on October 8, 2026, and was signed by Asier Erkoreka Arruza, Director of Security Coordination, on September 17, 2026, in Erandio. The proceedings are related to infringements of Organic Law 4/2015 of March 30.

Law and notification method

The announcement cites Organic Law 4/2015 of March 30, for the protection of citizens’ security, as the basis for the infringements. Since personal notification was unsuccessful, the public announcement provided for in Article 44 of Law 39/2015 of October 1 was used, which serves as an individual notification for each interested party.

The text was published in the section of other official announcements in Part I of the Boletín Oficial del País Vasco. The files are available for inspection at the Directorate of Security Coordination, located at Larrauri Mendotxe Bidea 18, Erandio, where interested parties may examine them, submit allegations, and propose evidence.

Period for allegations and reduction of the fine

  • A period of 15 business days, starting from the day following the publication of the announcement, to examine the file and submit allegations, documents, or information.
  • If no allegations are submitted within that period, the procedure may be considered as having moved to the resolution proposal, and the steps prior to the final resolution will be deemed completed.
  • If the fine is paid within 15 days following the notification, the amount is reduced by 50%, according to Article 54 of Organic Law 4/2015 of March 30.
  • The payment document is available at the aforementioned address in Erandio.

Types of infringements

The annex lists 37 proceedings, including the reference for each, the date of the infringement, the date of the resolution, and the article violated. The distribution according to the violated articles is as follows:

  • 36.10 LO 4/15: 13 proceedings.
  • 37.04 LO 4/15: 12 proceedings.
  • 36.16 LO 4/15: 7 proceedings.
  • 36.06 LO 4/15: 3 proceedings.
  • 36.03 LO 4/15: 1 proceeding.
  • 37.13 LO 4/15: 1 proceeding.

Most sanctions correspond to articles 36.10 and 37.04, which together make up more than two-thirds of the list. Article 36.16 includes seven proceedings, and the remaining three articles appear individually or in small numbers.

Dates and identification

  • The dates of the infringements range from October 6, 2025, to May 19, 2026.
  • The dates of the resolutions range from June 16 to September 16, 2026.
  • Interested parties are identified by DNI, NIF, NIE, or passport, and each proceeding has a reference starting with 405X.

The processing of sanctioning files has extended over several months, as in many cases there is a gap of between three and eleven months between the infringement and the resolution. The annex does not specify the economic amount of the fines.

Impact and consequences

This advertisement provides notification value to 37 interested parties who had not received individual notification. The failure to present allegations speeds up the procedure, turning the initial agreement into a resolution proposal, and paying the fine early results in a fifty percent reduction of the fine. Nevertheless, the Department of Security continues to carry out sanctioning procedures in the field of citizen security, always within the framework established by Organic Law 4/2015 of March 30.
