The directorate of Erandia has notified 51 sanctioning files in the field of security

The Department of Security of the Basque Country has initiated 51 sanctioning proceedings in accordance with the Organic Law on the Protection of Security (LOPSC, 4/2015), as personal notification to the interested parties could not be carried out. The Directorate of Security Coordination published the notification in issue number 172 of the Official Gazette of the Basque Country (BOPV) on 2026-09-09, and the interested parties have a period of 15 days to submit allegations.

The notification was signed by Director Asier Erkoreka Arruza in Erandio on 2026-08-25. Since no result was achieved after attempting personal notification, the announcement was published in accordance with Article 44 of Law 39/2015 (Common Administrative Procedure of Public Administrations).

Content of the files and deadlines

Interested parties have 15 business days, starting from the day following the publication of the announcement, to examine the file, submit allegations, documents, or information and, where applicable, propose evidence. The files are available at the address Larrauri Mendotxe Bidea 18, Erandio.

If no allegations are submitted within that period, the initiation of the sanctioning procedure will be understood as the resolution proposal, and all instruction steps will be considered completed. Furthermore, if the fine is paid within a period of 15 days, the amount will be reduced by 50%, according to Article 54 of the LOPSC.

Listed persons and infractions

The annex lists 51 interested parties, along with their DNI/NIF/NIE/passport number and file reference. The infractions correspond to various articles of the LOPSC:

  • Article 36.10: public security infractions.
  • Articles 36.06 and 36.16: infractions against public security.
  • Articles 37.01, 37.04, and 37.05: serious infractions.

The file references range from 405X2604375-03 to 405X2605486-05, and the dates of the infractions range from September 3, 2025, to April 25, 2026. The resolutions were issued between June 26 and August 18, 2026.

Consequences of the notification

This notification will have effect from the day following its publication in the Official Gazette of the State, serving as an individual notification for each interested party. The announcement is public so that the interested parties may be informed of their file and exercise their right to defense.

The volume of sanctioning proceedings demonstrates that there is active control and sanctioning activity in the field of public security in the Basque Country, and highlights the importance of the public notification system when interested parties cannot be located personally.
