Public Security delegates powers and nullifies previous delegations

The Undersecretariat of Public Security of the Ministry of Public Security issued exempt resolution No. 781, dated August 10, 2026, through which it delegates broad administrative powers to three division heads and nullifies previous delegations, reorganizing the agency’s decision-making process. The act was published in the Official Gazette of the Republic of Chile, No. 44,529, on Thursday, August 20, 2026, pages 1 to 6, under reference CVE 2854506.

The resolution, signed by the Undersecretary of Public Security, Pilar Giannini Bravo, is based on Law 21,730, which creates the Ministry of Public Security, and Law 18,575, the Constitutional Organic Law on General Bases of State Administration, whose Article 41 allows for the partial delegation of powers on specific matters. It also invokes Law 19,880 on administrative procedure, Law 19,886 on public procurement, and Law 20,285 on access to public information.

A single act to consolidate delegations

According to the recitals, the measure seeks to comply with the principles of efficiency, effectiveness, coordination, and procedural economy, and to consolidate current delegations into a single administrative act. The delegated matters for the Head of the Division of Administration, Finance, and Personnel and the Head of the Legal Division are updated, and a new delegation is incorporated for the Head of the Division of Security and Public Order.

The delegated powers are distributed into three main blocks:

• Division of Administration, Finance, and Personnel: public procurement (tenders, awards, direct contracting, fines, and early termination), asset administration, finance, and personnel management (holidays, working hours, permits, remuneration, teleworking, and training).
• Legal Division: all matters regarding transparency and access to public information regulated under Law 20,285, as well as the processing of matters before the Comptroller General of the Republic.
• Division of Security and Public Order: the resolution of requests from the Regional Ministerial Secretaries of Public Security through the personnel management portal.

Control and limits of delegation

The fifth article imposes on the delegated heads obligations of permanent control over the legality, timeliness, probity, efficiency, and effectiveness of their actions, as well as periodic and random reviews of processes and the semi-annual submission of a report of signed acts to the Undersecretary. The Undersecretariat’s Cabinet will provide the corresponding control instructions.

Article six expressly excludes from the delegation the signing of agreements that commit the Ministry or the Undersecretariat before other State bodies, foreign governments, or international organizations, as well as any act whose institutional, legal, or political relevance warrants the direct signature of the authority.

Previous delegations rendered null and void

Article seven renders null and void, as of the full processing of the resolution, exempt resolution 327 of 2025, and exempt resolution 52 of 2026, both from the Undersecretariat of Public Security, as well as any other delegation of powers or signature arranged previously that is contrary or incompatible. The resolution will be published in the Official Gazette and on the Undersecretariat’s Transparency Portal.

The measure implies an internal reorganization of the body created by Law 21.730, which concentrates daily administrative management in the division heads and reserves decisions of greater institutional relevance for the Undersecretary, in an attempt to streamline the processing of service matters.
