Ministry of Energy issues biofuel permit forms

The Ministry of Energy published this Monday, August 31, 2026, in the Official Gazette of the Federation (number 236/2026, page 4), the Agreement issuing the permit application forms and logs for the production, import, export, storage, transport, marketing, distribution, and public sale of biofuels. The document, signed by Secretary Luz Elena González Escobar, develops the new Biofuels Law and its regulations, and enters into force the day following its publication.
The agreement establishes a total of 22 forms distributed across seven annexes, ranging from permit and authorization applications to operation logs and notices of commencement, modification, assignment, and extension. With this, the agency fulfills the powers granted to it by law to grant, modify, suspend, and revoke permits in the matter, within the framework of the national biofuels policy.
Regulatory Framework
The agreement is based on the Biofuels Law, published in the Official Gazette of the Federation on March 18, 2025, the purpose of which is to regulate and promote the sustainable development of biofuels to contribute to energy sovereignty, justice, and self-sufficiency. It is complemented by the Regulations of the Biofuels Law, published on October 3, 2025, which regulates the activities of production, storage, transport, import, export, marketing, distribution, and public sale.
The issuance of the forms also responds to the National Development Plan 2025-2030, in its Transversal Axis 2 of public innovation, which promotes the simplification, digitalization, and reduction of resolution times for administrative procedures. Processing is channeled through the General Directorate of Renewable Energies of the Undersecretariat of Planning and Energy Transition.
The Issued Forms
The agreement includes permit applications for the eight main activities and one specific authorization, in addition to the corresponding logs:
- Permit application for the production, import, export, storage, transport, marketing, distribution, and public sale of biofuels (Annex 1).
- Application for authorization for the production or utilization of biofuels (Annex 2).
- Logs for each of the permits and for the production authorization (Annex 3).
- Notice of commencement of operations for permits and authorizations (Annex 4).
- Application for modification or suspension of permits and authorizations (Annex 5).
- Application for assignment of permits and authorizations (Annex 6).
- Application for extension of permits and authorizations (Annex 7).
The formats include fields to record the types of biofuels—such as biogas, biomethane, bio-jet fuel, bioethanol, and biodiesel—national and imported volumes, and notes regarding the addition, withdrawal, or change of permitted biofuels.
Validity and Repeal
The agreement enters into force the day following its publication in the Official Gazette of the Federation (Diario Oficial de la Federación). Likewise, it nullifies the Agreement issuing the permit application formats for the production, storage, transport, and commercialization of bioenergetics of the anhydrous ethanol and biodiesel type, published on November 13, 2009, which is replaced by the new regulatory framework.
The measure represents a concrete step in the consolidation of the biofuels market in Mexico by providing private parties with clear and standardized formats to obtain and operate their permits. For those interested in the energy transition, the publication facilitates access to procedures and makes requirements transparent, in line with the goal of reducing pollutant and greenhouse gas emissions through the utilization of biomass and organic waste.
