Secastilla declares the public utility of the expropriation of plot 12 of polygon 5
Por FactBox Admin

The Secastilla City Council has declared the public utility and the need for occupation of 354.45 square meters of polygon 5, plot 12 of that municipal district, in order to execute the improvement of the layout of the road entering the town. This was agreed upon by the Plenary on October 29, 2026, and the agreement is published in the Official Gazette of the Province of Huesca number 213, dated Friday, November 6, 2026, in the Local Administration section, with the official reference BOPH-2026-213043.
A section of a sharp curve at the town entrance
The action motivating the expropriation is the technical project for the “Improvement of the road layout at the entrance of Secastilla,” definitively approved by the Provincial Council of Huesca via decree number 3679, dated October 21, 2026. The municipal Plenary declares that this work implies the occupation of the affected land for reasons of public interest linked to the improvement of road safety, traffic flow, and accessibility.
The file is processed under the Forced Expropriation Law of December 16, 1954, and the publication of the agreement complies with the provisions of articles 18 and 21, in order to open the public information period and personally notify the interested parties.
Owner, surface area, and valuation
The agreement nominally identifies the owner and details the assets and rights to be occupied, with the following data:
- Owner: José María Laplana Larruy and his possible heirs.
- Affected area: 354.45 square meters of polygon 5, plot 12 of Secastilla.
- Included construction: a building of 71 square meters is located within the area to be expropriated.
- Valuation: 7,053.53 euros, according to the appraisal by the municipal technician.
- Purpose: execution of the works to improve the layout of the access road.
The Plenary definitively approves the concrete, individualized, and valued list of assets and rights, as well as the nominal designation of the interested parties with whom subsequent procedures must be conducted.
Transfer to the Public Prosecutor’s Office and urgent processing
Among the nine points of the agreement, the City Council arranges to transfer the proceedings to the Public Prosecutor’s Office, with whom subsequent actions regarding the affected plot will be coordinated. Likewise, it considers the need for occupation to be proven and establishes that the agreement itself forms part of the expropriation file.
The City Council also requests the Government Council of Aragon to declare the urgent occupation of assets and rights, under Article 52 of the Compulsory Expropriation Law. The request is justified by the fact that the road currently features a very sharp curve with reduced visibility, which hinders traffic flow and increases the risk of collision; according to the text, this configuration has created dangerous situations and some accidents among road users.
The City Council maintains that the availability of the land is indispensable for executing the works and that any delay would prolong the current conditions of insecurity. Therefore, it empowers the Mayor’s Office, held by José Lorenzo Rabal Miranda, to complete the documentation, send the file to the Government of Aragon, and attend to the processing requirements. The agreement is signed in Secastilla on November 5, 2026.
Fifteen-day period for allegations
The publication opens a public information period of fifteen days in the Official Provincial Gazette and on the single edictal board of the Official State Gazette, with personal notification to the interested parties, who may submit allegations and examine the file.
The agreement directly affects the owners of the property, who will see their area reduced by 354.45 square meters and will lose a building of 71 square meters, compensated with 7,053.53 euros according to the municipal appraisal. For the municipality, the operation is the administrative path prior to a work intended to correct a black spot on the entrance road, although the effective occupation remains pending the decision of the Aragonese Executive regarding the urgency.
