Sarria declara urxentes cinco procesos da OPE 2023 e reduce prazos

The mayor of Sarria, Claudio Melquiades Garrido Martínez, signed Decree 2026-1604, dated October 15, 2026, declaring the urgency processing of five selection processes included in the council’s 2023 Public Employment Offer (OPE). The resolution is published in the Official Gazette of the Province of Lugo number 241, dated October 21, 2026, with reference R. 2837, and reduces the ordinary processing deadlines by half. In total, the measure affects 15 positions pending to be filled.

The argument of the three non-extendable years

The decree stems from a specific situation: the bases for the five processes have already been approved, and only the publication of the announcements in the official gazettes remains. According to the text, the 2023 OPE must be resolved within the non-extendable period of three years established by article 48.4 of Law 2/2015, of April 29, on public employment in Galicia, and this circumstance is what motivates the acceleration.

The urgency processing is supported by article 33 of Law 39/2015, of October 1, on the common administrative procedure of public administrations, and the competencies that article 21 of Law 7/1985, of April 2, regulating the bases of the local regime grants to the mayor. The mayor justifies the decision based on reasons of public interest, with the objective that the processes are completed before the offer expires.

Fifteen positions in five processes

The positions and the rules regulating them are as follows:

  • Tourist information officer, career civil servant: bases approved by Decree 2026-1579, of October 9, 2026.
  • 5 parks and gardens operators, fixed-discontinuous labor personnel for 4 months: Decree 2026-1580, of October 9, 2026.
  • 1 tourist information officer, fixed-discontinuous labor personnel for 4 months: Decree 2026-1574, of October 8, 2026.
  • 6 local road operators, fixed-discontinuous labor personnel for 8 months: Decree 2026-1569, of October 8, 2026.
  • 2 tractor drivers, fixed-discontinuous labor personnel for 8 months: Decree 2026-1570, of October 8, 2026.

Only one of the positions is for a career civil servant. The remaining fourteen correspond to fixed-discontinuous labor personnel, with contracts of four months (parks and gardens and tourist information officer) or eight months (local roads and tractor drivers).

Deadlines halved, with two exceptions

The second point of the decree orders the reduction by half of the deadlines established in the ordinary processing, but leaves two intact: the deadline for submitting applications for participation and the deadlines for filing administrative and/or judicial appeals. In practice, applicants have the same amount of time to register, while the subsequent phases of the procedure are shortened.

The bases are published on the notice board and on the transparency portal of the municipal electronic office, https://sarria.sedelectronica.es, as stated in the announcement itself.

No appeal against the declaration of urgency

The third point warns that, according to article 33.2 of Law 39/2015, no appeal may be filed against the agreement declaring the application of urgency processing. Opposition to the measure can only be alleged by the interested parties for its consideration in the resolution that ends the procedure.

The decree also orders the publication of the resolution on the electronic headquarters of the Sarria City Council and in the BOP of Lugo, a procedure that was materialized with the insertion on page 18 of number 241.

The decision has a direct effect on the applicants for the 15 positions and on the organization of the municipal staff: anyone wishing to apply must consult the bases on the electronic headquarters and monitor the calendar, because the evaluation and resolution phases will advance at double the speed of an ordinary process, although the registration period remains unchanged.
