Sant Feliu de Buixalleu declares the occupation of 705.36 m² of land definitive

The City Council of Sant Feliu de Buixalleu has fully dismissed the allegations presented by a property owner and has definitively declared the need to occupy 705.36 m² of two plots in the municipality, intended for assignment to the essential municipal public service of domestic drinking water supply. The agreement of the Municipal Plenary of September 22, 2026, is published in the Official Gazette of the Province of Girona no. 190, of October 2, 2026, with the official reference BOP-2026_0_190_8397 and file number X2026000231.

The text, electronically signed by the mayor Xavier Santos Rodoreda on September 24, 2026, resolves the allegations formulated by J.C.B. (DNI 40842137W) on April 30 and May 21, 2026, registered under numbers E2026001447 and E2026001782. The resolution is framed within the Law of December 16, 1954, on compulsory expropriation, and is made public in accordance with articles 18 and 21 thereof.

Dismissal of allegations and definitive declaration

The Municipal Plenary agreed, firstly, to fully dismiss the allegations presented by the affected owner, based on the legal and technical reasoning contained in the same agreement. Secondly, it definitively declared the need to occupy the affected assets, which are to be incorporated into registered property 1135 of Sant Feliu de Buixalleu.

The file stems from an initial proposal for the declaration of utility and need to occupy plots no. 43 and 44 of Polygon 8, processed by the City Council to guarantee the drinking water supply to the municipality.

The affected lands

The total surface area subject to occupation is 705.36 m², coming from two cadastral plots of Polygon 8:

• 254.27 m² of plot 43, with cadastral reference 17169A008000430000YI.
• 451.09 m² of plot 44, with cadastral reference 17169A008000440000YJ.

The lands are incorporated into registered property 1135 of the municipality and the owner affected by the procedure is J.C.B. (40842137W).

Publication, notification, and deadlines

The municipal agreement provides for a series of publicity and communication procedures:

• Publish the resolution in the Official Gazette of the Province of Girona and on the municipal notice board.
• Notify the adoption of the agreement to J.C.B. (40842137W), owner of the affected lands, indicating the appeals that may be filed.
• Publish the agreement for a period of 15 business days, counting from the day after its publication in the Official Gazette of the Province of Girona, as well as in the Girona newspaper and on the municipal notice board.

The resolution bears the electronic signature date of September 24, 2026, and is signed by the mayor, Xavier Santos Rodoreda, with the approval of the Provincial Council of Girona.

The definitive declaration of the need for occupation is the preliminary step to the effective expropriation of the land and enables the City Council to incorporate them into the registry property 1135 for the drinking water service.
