Health authorities notify a sanctioning proceeding of 3,000 euros in Pontevedra

The Department of Health (Consellería de Sanidade) has notified the initiation of sanctioning proceedings in health matters against the holder of NIF 36140812S, with the last known address in Vigo. The agreement, number 20260185VS-PO, was issued on August 12, 2026, by the territorial director of Pontevedra and is published in the Official Gazette of Galicia (DOG) number 187, of October 1, 2026, on page 51086.

Notification by way of announcement

The announcement, signed on September 22, 2026, by the territorial director María Dolores Bazán Arcay, is due to the fact that the personal notification of the agreement could not be carried out in accordance with article 40 and following of Law 39/2015, of October 1, on the common administrative procedure of public administrations. Therefore, the Administration resorts to notification by announcement provided for in article 44 of the same regulation, so that the interested person becomes aware of the content of the agreement.

The effectiveness of the notification is subject to its publication on the notice board of the Official State Gazette (Boletín Oficial del Estado).

Imputed facts and proposed sanction

According to the annex of the announcement, the imputed facts consist of an alleged infringement of article 15 of Law 8/2008, of July 10, on the health of Galicia, modified by Law 3/2026, of March 30, establishing prevention and comprehensive protection measures against violence in the Health System of Galicia.

The classification corresponds to two administrative infractions classified as minor in article 41.ter of Law 8/2008:

• Lack of respect or insult to health authorities and their agents and the professionals referred to in the second paragraph of point 23 of article 3.
• Breach of the relationship of trust during the exercise of their functions or on the occasion thereof, when they do not constitute a serious or very serious infringement.

The proposed sanction amounts to 3,000.00 euros.

Rights of the interested person

• Allegations: a period of fifteen business days counting from the day following the publication of the announcement, before the Territorial Department of Pontevedra (article 76 of Law 39/2015).
• Consultation of the file: department offices, in the Administrative Building of the Xunta de Galicia, avenida María Victoria Moreno, number 43, 1st floor, Pontevedra, with the right to obtain a copy (article 53.1.a).
• Proposed resolution: if no allegations are presented within the period, the initiation agreement may be considered a proposed resolution when it contains a precise statement on the imputed responsibility (article 64.2.f).
• Reductions: before the resolution of the procedure, the interested person is entitled to the reductions established in article 85 of Law 39/2015.
