Health notifies a company from Quintanar del Rey by edict of the sanctioning procedure.

The Provincial Delegation of the Regional Ministry of Health in Cuenca has notified by edict the decision to initiate sanction proceedings 16/032/2026-S against a company in Quintanar del Rey for a violation in the area of public health. The notice, signed on 6 August 2026, is published in issue No. 155 of the Official Gazette of Castilla-La Mancha (DOCM) of 14 August 2026 (reference 2026/6007), after personal notification to the interested party could not be carried out.

The decision to initiate proceedings was issued on 1 July 2026 by the provincial delegate of the Regional Ministry of Health. Since direct notification proved unsuccessful, the Administration resorts to notification by edict through insertion in the Official State Gazette (BOE) and in the DOCM, in accordance with Articles 44 and 46 of Law 39/2015 of 1 October on the Common Administrative Procedure of Public Administrations.

A procedure published after direct notification fails

The notice explains that, having attempted notification and not having been able to carry it out, the extract of the decision to initiate proceedings is made public. The interested party is identified solely by its Tax ID (NIF) B16342594, located in Quintanar del Rey (Cuenca); the edict does not detail the specific violation alleged, which is broadly framed within matters of public health.

This mechanism allows the sanctioning procedure to advance without the failure to locate the addressee paralysing the proceedings, while ensuring that the interested party can exercise their rights by being formally informed of the opening of the procedure.

Allegations within fifteen working days from the BOE

The deadline for submitting allegations is fifteen working days, counted from the day following the publication of the notice in the BOE. During that period, the company may appear to learn the full content of the administrative act:

  • Deadline: 15 working days from the day following publication in the BOE.
  • Place: Provincial Delegation of the Regional Ministry of Health (Legal Section), C/ de las Torres No. 43, Cuenca.
  • Hours: from 09:00 to 14:00.

The publication appears in Section III (“Other provisions and acts”) of the DOCM, on page 30260 of issue No. 155 of the gazette, corresponding to year XLV of the publication.

Signature and processing of the edict

The document, dated in Cuenca on 6 August 2026, is signed by José María Pastor Cañada, provincial delegate of the Regional Ministry of Health in Cuenca, the competent body to issue the decision to initiate proceedings 16/032/2026-S. The notification is processed simultaneously in the BOE and in the DOCM, as required by the common administrative procedure regulations for cases of notification by edict.

Relevance for readers

Publication by edict ensures that the sanctioning procedure can continue without undermining the interested party’s right of defense: although the company could not be located through ordinary channels, the notice allows it to learn of the opening of the proceedings and to submit allegations within the deadline. It should be recalled that, in accordance with Law 39/2015, the notification is deemed to have been made from the publication in the BOE, so the time limits run from that date, not from the dissemination in the regional newspaper.
