Health Ministry opens public consultation for the decree that will replace Decree 157/2014

The Department of Health has opened the prior public consultation for the draft decree of the Consell regulating the authorization, registration, and healthcare guarantees of health centers, services, and establishments in the Valencian Community. The announcement is published in the Official Gazette of the Generalitat Valenciana (DOGV) number 10461, dated September 29, 2026, under the official reference DOGV-C-2026-30322. Citizens and potentially affected organizations have fifteen calendar days, counting from the day following publication, to submit their contributions.

The initiative aims to fully replace Decree 157/2014, of October 3, of the Consell, which establishes health authorizations and updates, creates, and organizes the health planning registries of the Department of Health. With the new text, the Generalitat intends to adapt its regional regulation to Royal Decree 1277/2003, of October 10, in its current wording.

The announcement details that the adaptation responds, in particular, to the modifications introduced by Royal Decree 239/2026, of March 25, in four specific areas:

• Minimum authorization requirements.
• Healthcare guarantees.
• Patient safety.
• Healthcare provision.

Legal basis of the procedure

The procedure is carried out in compliance with Article 133.1 of Law 39/2015, of October 1, on the common administrative procedure of public administrations, and Articles 14 and 15 of Law 4/2023, of April 13, of the Generalitat, on citizen participation and the promotion of associations in the Valencian Community.

Article 38 bis of Decree 24/2009, of February 13, of the Consell, regarding the form, structure, and procedure for drafting regulatory projects of the Generalitat, is also invoked. The stated objective is to gather the opinions of citizens and affected organizations before drafting the final text.

The enabled period is fifteen calendar days from the day following the publication of the announcement, that is, until October 14, 2026. The planned channels are as follows:

The announcement was signed in València on September 3, 2026, by Joaquín Alfonso Andani Cervera, Undersecretary of Health, and is published in section V of the DOGV announcements, within the other matters section.

Who it affects

The future regulation directly affects private and contracted clinics and health centers, the professionals providing services within them, and the patients receiving their care, as it reorganizes the authorization and registration conditions and establishes the required healthcare guarantees. The complete replacement of Decree 157/2014 means that the health authorization procedures and health planning registries in effect for over a decade will be redefined by the new regulation.
