Salud emplaza a interesados en el recurso contra la lista de Radiofísica

The General Secretariat of the Regional Ministry of Health has summoned those interested in Ordinary Procedure 291/26 of the Contentious-Administrative Chamber of the High Court of Justice of Cantabria, opened following the appeal filed by Samuel Ruiz Arrebola against the resolution of the Minister of Health dated September 2, 2026, which published the list of successful candidates for Hospital Radiophysics. The announcement appears in the Official Gazette of Cantabria no. 213, dated November 5, 2026, within section 2.3 (Others), with the official reference CVE-2026-8590. The deadline to appear is nine days.

The litigation is directed against the Resolution of the Minister of Health of September 2, 2026, by which the list of candidates who passed the selective tests for access, via competitive examination, to positions in the statutory category of Specialist Area Physician of Hospital Radiophysics of Health Institutions of the Autonomous Community of Cantabria, convened by Order SAL/51/2023, of December 26, and the offered positions, was made public.

That resolution, signed by Minister César Pascual Fernández, was published in the Official Gazette of Cantabria no. 174, dated September 9, 2026 (ref. CVE-2026-7019), and set a period of twenty calendar days to submit documentation and request a position through the ORION application of the Cantabrian Health Service.

A process with five successful candidates and five destinations

The appealed resolution closed the selection process with the following data:

  • Five candidates passed the tests via the open call, with scores between 99.330 and 86.945 points.
  • Five positions offered, all in the Specialized Care Management Area I: Marqués de Valdecilla University Hospital, in Santander.
  • Allocation by order of precedence and preference of choice for those accessing through internal promotion, in accordance with article 34.6 of Law 55/2003, of December 16.
  • A period of twenty calendar days to provide the degree, functional capacity, and responsible declarations, among other documents.

Nine days to appear as a defendant

The summons is issued under Article 49 of Law 29/1998, of July 13, regulating the Contentious-Administrative Jurisdiction. The General Secretariat warns that the granting of the plaintiff’s claims may affect the legitimate interests of third parties; therefore, those who consider themselves affected have nine days to appear and present themselves before the court in the manner provided for in Article 23 of the same law.

Anyone who appears after the deadline shall be considered a party without the proceedings being rolled back or interrupted; if they do not appear, the litigation shall continue through its procedures without further notification. The notice was signed in Santander on October 30, 2026, by the general secretary, María Souto Aller.

Second notice in the same department

This is not the first summons of this type in the Cantabrian health sector this year. The Official Gazette of Cantabria no. 158, of August 18, 2026 (ref. CVE-2026-6537), published another summons in ordinary procedure 193/26, in that case regarding an appeal by Leticia Peña Sanz against the final results of the process for Senior Specialist Technician in Radiodiagnosis convened by Order SAN/36/2022, of December 28, and against the presumed dismissal of her administrative appeal.

The resolution now being appealed expressly recognized the judicial route: one month for the optional appeal for reversal before the Health Counselor or two months to go directly to the Contentious-Administrative Chamber of the High Court of Justice of Cantabria, deadlines which the plaintiff has exhausted by filing the appeal.

The outcome of Ordinary Procedure 291/26 could alter the awarding of five specialist positions in a service critical to Cantabrian healthcare, as Hospital Radiophysics covers radiotherapy treatments and radiation control in health centers. Therefore, the notice is of interest both to the candidates who have already obtained a position and to those who could benefit from a total or partial annulment of the process: only by appearing within nine days will they be able to defend their position in the litigation.
