SACYL appoints an anesthesiologist from Burgos as a permanent staff member following a ruling by the TSJCyL

The General Directorate of Personnel and Professional Development of the Regional Health Management (SACYL) has resolved to appoint Sergio Castillejo Pérez as permanent statutory personnel in the category of Specialist Degree in Anesthesiology and Resuscitation, assigned to the University Healthcare Complex of Burgos. The appointment is published in the Official Gazette of Castilla y León number 164, dated August 25, 2026, by resolution of August 18, 2026 (official reference BOCYL-D-25082026-164-1).

The decision stems from judgment no. 99/2025 of the Contentious-Administrative Chamber of the High Court of Justice of Castilla y León, Burgos seat, issued in ordinary procedure 131/2024, the compliance of which was ordered by Order SAN/1519/2025, dated December 19. The ruling granted the interested party a total score of 40.10 points in the stabilization selection process, which allowed him to pass the competition and qualify for a position.

An appointment derived from the stabilization of temporary employment

The process is part of the exceptional stabilization plan for temporary employment convened by Order SAN/1916/2022, dated December 23, under Law 20/2021, dated December 28, on urgent measures for the reduction of temporality in public employment. The list of candidates who passed the merit competition was approved by Order SAN/332/2024, dated April 16, and was completed with the complementary list of Order SAN/1151/2024, dated October 30.

Retroactive effects and taking office

The resolution establishes that the effects of the appointment are retroactive to May 25, 2024, the first day on which the interested party could have taken office according to the resolution of May 22, 2024, which appointed the permanent staff of the category. The candidate has a period of one month from the date of publication to take office at the Management to which the position is assigned, under penalty of forfeiting their rights except in cases of force majeure.

During the act of taking office, he must take an oath or promise to abide by the Constitution, the Statute of Autonomy of Castilla y León, and the laws, and make the declaration of compatibility provided for in Decree 227/1997, dated November 20.

Appeals and relevance of the case

Against the resolution, which exhausts the administrative route, a contentious-administrative appeal may be filed within two months of its publication, as well as an optional appeal for reversal before the Minister of Health and Social Welfare within one month. The resolution is signed by the Director General of Personnel and Professional Development, Sonsoles García Rodríguez, by virtue of the delegation of powers of Order SAN/1705/2007.
