Rucandio opens the call to elect its substitute justice of the peace

The Rucandio City Council has opened the call to propose to the Governing Chamber of the High Court of Justice of Castilla y León the appointment of a resident of the municipality as a substitute justice of the peace. The decision corresponds to the Plenary of the corporation, which will submit the proposal once the deadline for submitting candidacies has closed. The announcement is published in the Official Gazette of the Province of Burgos number 178, dated September 18, 2026, with the official reference BOPBUR-2026-03872.
The call is issued to comply with the provisions of articles 101 and 102 of the Organic Law of the Judiciary, which regulate the figure of justices of the peace and their substitutes in municipalities where there is no court of first instance. The text is signed in Rucandio on September 8, 2026, by the mayor, Rubén Fernández Ojeda, and is addressed to the residents of the six towns that make up the municipal district.
Requirements for applicants
Residents interested in holding the position must meet the following conditions:
- Be Spanish and a resident of the municipality of Rucandio, which includes the towns of Herrera, Hozabejas, Huéspeda, Madrid de Caderechas, Ojeda, and Rucandio.
- Be of legal age and meet the requirements established in the Organic Law of the Judiciary for entry into the judicial career.
- Not belong to or work for any political party or trade union, in accordance with article 23 of the Regulations for Justices of the Peace of June 7, 1995, published in the Official State Gazette on July 13, 1995.
- Not be subject to any cause of incapacity or incompatibility provided for in article 102 of the Organic Law of the Judiciary, with the exception of those derived from age retirement, provided that this does not constitute a physical or psychological impediment to performing the duties of the office.
Documentation and method of submission
The application for election to the position must be addressed to the Rucandio City Council and accompanied by the required supporting documentation:
- Photocopy of the applicant’s DNI (National ID).
- Sworn statement that they are not subject to any cause of incompatibility or prohibition provided for in the Organic Law of the Judiciary and in article 23 of the Regulations for Justices of the Peace.
Deadline of twenty calendar days
The deadline for the submission of applications is twenty calendar days, counted from the day following the publication of the announcement in the Official Gazette of the Province of Burgos. With the publication on September 18, 2026, the count begins on September 19 and extends until October 8, 2026. Once that period has concluded, the Plenary of the Rucandio City Council will agree upon the proposal to be sent to the Governing Chamber of the High Court of Justice of Castilla y León, the competent body for the appointment.
The call for applications affects a small and dispersed municipality, where the justice of the peace assumes functions of conciliation, civil registry, and judicial assistance without the need to travel to the capital. The selection of the substitute guarantees the continuity of this service when the holder cannot exercise it, so the neighborhood response within the open period will determine that the position is filled without interruptions.
