The decree is based on article 12 of Royal Legislative Decree 5/2015, of October 30, and articles 104 and 104 bis of Law 7/1985, as well as articles 9 and following of Decree 214/1990, of July 30.

The temporary staff ceiling, adjusted by the Plenary
The decree stems from two plenary agreements that set the maximum number of temporary positions and their remunerations. The Plenary of June 28, 2023, determined three full-time positions at 51,459.00 euros per year and seven part-time positions at 25,729.50 euros per year. Subsequently, the Plenary Agreement of July 24, 2025, updated this maximum:

Appointments are conditional upon being provided for in the staff list and the List of Job Positions. With the appointment now published, the council fills one of the six current part-time positions.
Procedures, control, and publicity
The decree also approves the AD accounting document with prior entry number 920260005389 to cover the expenses of the file. The resolution must be notified to the interested party and forwarded to the Human Resources Service and the Municipal Comptroller. Additionally, it is planned to be published in the Official Gazette of the province, the Official Gazette of the Generalitat de Catalunya, and on the corporation’s notice board, and to be reported to the Plenary at the next plenary session. The document is signed by the general secretary, Josep Manuel Colell Voltas, in Rubí on September 25, 2026.
The termination regime is that typical of this type of position: the appointment and termination correspond exclusively to the Mayoralty-Presidency of the corporation, without the competence being delegable, and the person may be dismissed or separated freely at any time during the mandate. Termination will occur, in any case, when that of the authority to whom the trust or advisory function is provided occurs.
The publication is relevant because it provides a record of the cost and the size of the trust personnel structure of Rubí: each partial position represents 25,729.50 euros annually, and the decree confirms that the municipality maintains six positions of this type within the ceiling set by the Plenary of July 2025.
