Riudoms delegates the management and collection of fines to the Provincial Council.

The City Council of Riudoms has commissioned the Provincial Council of Tarragona to manage infringements of the ordinance on civic coexistence and use of public spaces and to collect the pecuniary sanctions deriving from them. The agreement, formalised on 27 July 2026, was published in the Official Gazette of the Province of Tarragona (BOPT) of 12 August 2026 under reference CVE 2026-07477.

The agreement was approved by the Plenary of the Provincial Council of Tarragona at its session of 26 June 2026, after the municipal plenary of Riudoms validated it on 21 May. Execution will correspond to BASE-Gestió d’Ingressos, an autonomous body of the Provincial Council, and publication is made in compliance with article 10.3 of Law 26/2010, of 3 August, on the legal regime and procedure of the public administrations of Catalonia. The document is signed by the president of the Provincial Council, Noemí Llauradó i Sans, and the mayor of Riudoms, Ricard Gili Ferré, assisted by the general secretary of the Corporation, Josep Maria Sabaté Vidal, and by the municipal secretary; the notice in the BOPT is signed by the secretary of BASE, Alberto José Arnau Esteller.

A management assignment and a delegation of collection

The agreement combines two legal figures: the management assignment, under article 11 of Law 40/2015, of 1 October, on the legal regime of the public sector, and the delegation of collection, based on article 7 of the consolidated text of the Law regulating local finances (Royal Legislative Decree 2/2004, of 5 March). The assignment does not involve the transfer of ownership of the competence: the City Council retains the sanctioning power and maintains the faculty to issue legal resolutions.

In the field of management, BASE-Gestió d’Ingressos will assume:

  • Design and supply of complaint forms and of the IT solutions for drawing up and processing files.
  • Instruction of sanctioning procedures, excluding precautionary measures, which the City Council will process in a separate file.
  • Notification of administrative acts, document management of files and attention to interested parties.

In matters of collection, the delegation includes:

  • Issuance and notification of complaints made by municipal officers.
  • Enforcement orders for non-payment and collection in voluntary and enforcement periods.
  • Assessment of late-payment interest, deferrals and instalment plans, and resolution of appeals.
  • Legal defence and representation before courts and tribunals.

A new circuit for collecting fines

The Riudoms City Council will not be able to directly collect the amounts of the fines: they must be deposited into the restricted accounts of BASE-Gestió d’Ingressos. As an exception, payment by card is allowed through the point-of-sale terminals (POS) provided by the agency, as well as cash collection by municipal staff, who must deposit the amount into the restricted account within a maximum of ten days.

The agreement also sets the deadlines and coordination bodies:

  • The complaint reports must be forwarded to BASE within fifteen days of their formalisation; if the delay exceeds this deadline by 50 per cent, the agency may refuse to process the file.
  • BASE will transfer to the City Council monthly the amount collected, reduced by the fee set in the fiscal ordinance and refunds, within the first twenty calendar days of the following month.
  • The instructor and the secretary of the proceedings will be appointed by the City Council at BASE’s proposal and must be officials of the agency or of the Provincial Council.
  • A monitoring committee made up of three members from each party and chaired by BASE’s chairperson will meet at least once a year, and the management report must be submitted before 30 April.

Validity and oversight of the agreement

The agreement will take effect upon its publication in the BOPT and will last for two years, with the possibility of extension for one additional year. Its effects will also extend to complaints made before it comes into force and will render void any previous agreements with a similar purpose. The grounds for termination include mutual agreement, serious non-compliance, termination by one of the parties with two months’ notice, and the repeal or amendment of the municipal ordinance.

With this agreement, the processing and collection of coexistence fines in Riudoms move to the provincial revenue management network, which serves interested parties at the office at carrer de l’Assalt, 12, in Tarragona, and by remote means. For sanctioned residents, the change entails a unified procedure for notification, payment and appeals managed by BASE-Gestió d’Ingressos, under the same regime that the Provincial Council applies to the other municipalities subscribed to the service.
