Rioja Salud faces three new legal proceedings over night shift supplements
Por FactBox Admin

The Official Gazette of La Rioja publishes this Wednesday, October 14, 2026, three summonses to potential interested parties in three separate contentious-administrative proceedings directed against the Riojan Health Service. The matters, processed as abbreviated proceedings 147/2026, 149/2026, and 217/2026, claim the payment of the continuous care remunerative supplement in its modalities A and B—night shifts and holidays—during the vacation period. All three are being heard before the Court of First Instance of Logroño, in its Contentious-Administrative Section number 2.
The announcements occupy section III of the gazette, dedicated to “Other provisions and acts,” and appear signed by the Director of Human Resources of the Management of the Riojan Health Service, María Begoña Lema De Pablo. The publication responds to the decrees issued by the judicial body on September 1 and 17, 2026, which order the summoning of anyone who may have an interest in the proceedings so that they may appear if it suits them.
The Riojan Health Service appears as the defendant in all three cases, while the plaintiff in each is a different healthcare professional. The coincidence of the object and the judicial body points to repeated and coordinated litigation regarding the same remunerative concept.
The three published proceedings
- P.A. 147/2026: plaintiff María Victoria Nebreda Usón; Decree of September 1, 2026; summons signed in Logroño on October 13, 2026 (reference BOR-A-20261014-III–3879, p. 17351).
- P.A. 149/2026: plaintiff María Cruz Lázaro González; Decree of September 1, 2026; summons signed on October 13, 2026 (reference BOR-A-20261014-III–3878, p. 17352).
- P.A. 217/2026: plaintiff Julia García Daroca; Decree of September 17, 2026; summons signed on September 18, 2026 (reference BOR-A-20261014-III–3873, p. 17354).
Object of the claim and competent body
The three matters share the exact same object: the request for payment of the continuous care remunerative supplement, modalities A and B, corresponding to night shifts and holidays, during the vacation period. This is a concept linked to the organization of working time for healthcare personnel, whose economic compensation during vacation periods is the point of friction between the plaintiffs and the regional health administration.
The requesting judicial body is, in all three cases, the Court of First Instance of Logroño, Contentious-Administrative Section number 2, based in Logroño. The type of process is contentious-administrative, and the processing follows the channel of the abbreviated procedure.
Deadlines and effects of the summons
The appearance period is 9 business days starting from the day following the notification of the announcement. The bulletin warns that if the interested parties do not appear, the procedure will continue without any further notification being served to them. The summons will also be incorporated into the administrative file, which will be forwarded to the requesting judicial body.
Background of Increasing Litigation
The three announcements do not constitute an isolated episode. Since August 12, 2026, the Official Gazette of La Rioja has been publishing summons of an identical nature against the Riojan Health Service, including those corresponding to the summary proceedings 225/2026 and 213/2026 (August 12), 166/2026, 190/2026 and 156/2026 (September 8), 189/2026, 193/2026 and 210/2026 (September 15), 191/2026 (September 16) and 200/2026, 201/2026 and 202/2026 (September 22). In total, there are at least fifteen proceedings with the same object and the same defendant in barely two months.
The signing of the summons always corresponds to the Human Resources Directorate of the Management of the Riojan Health Service, which confirms that the health administration is centrally assuming the defense in this wave of claims.
The trickle of proceedings has a double reading for the readers. On one hand, it evidences a widespread labor conflict between health personnel and the Riojan Health Service regarding the remuneration of night shifts and holidays during vacations, with dozens of professionals claiming through judicial channels. On the other, it anticipates an eventual impact on the Riojan public coffers if the judicial resolutions end up recognizing the right to the supplement, as each favorable ruling could extend the criteria to the entire affected workforce.
