Rioja Alavesa declares two abandoned vehicles as municipal waste

The Cuadrilla de Rioja Alavesa has initiated the procedure to declare two vehicles allegedly abandoned in the municipalities of Elvillar and Lapuebla de Labarca as municipal waste, and requires their owners to proceed with their removal within a period of fifteen calendar days. This is stated in the notification of Presidency Resolution number 2026-90, dated July 21, 2026, published in the Official Gazette of the Historical Territory of Álava (BOTHA) number 104, dated September 11, 2026.
As personal notification to the interested parties could not be carried out, the provincial administration resorts to notification by announcement, in accordance with Article 44 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations. The procedure is processed through files 2026/686/S02.01.02.01 and 2026/642/S02.01.02.01.
The affected vehicles
The two vehicles subject to the procedure are located in respective municipalities of the region and have the following characteristics:
- Elvillar: a SEAT Córdoba, license plate 3509 BXL, parked on a plot adjacent to Cerro Street.
- Lapuebla de Labarca: a Peugeot 406, license plate M-2487-YT, parked on Senda del Soto Street.
Through the resolution, the administrative procedure is initiated to determine the appropriateness of declaring both vehicles as municipal waste.
Deadline and procedure for owners
The owners or those holding rights over the vehicles are required, within a period of fifteen (15) calendar days, to proceed with their voluntary removal or to submit allegations and provide the documents or justifications they deem appropriate in defense of their rights.
The aforementioned period will be calculated from the day following the publication of the notification announcement in the Official State Gazette, pursuant to Article 44 of Law 39/2015.
Consequences if not removed
Interested parties are expressly warned that, if the granted period expires and they do not proceed with the removal of the vehicle nor present sufficient allegations to disprove the state of abandonment, a resolution may be issued declaring the vehicle as municipal waste and ordering its removal and delivery to an authorized treatment center.
The removal may be carried out through subsidiary execution when appropriate, with the costs incurred being charged to the responsible persons in accordance with applicable regulations. The resolution subject to notification constitutes a procedural act; therefore, no administrative appeal may be filed against it, without prejudice to the fact that interested parties may submit the allegations they deem appropriate for consideration in the resolution that ends the procedure, in accordance with Article 112 of Law 39/2015.
The resolution and the respective files are available to interested parties at the offices of the Cuadrilla de Rioja Alavesa, where they may appear for their knowledge and consultation. The document was signed in Laguardia on September 3, 2026, by the president of the Cuadrilla, José María Elvira Ceballos.
The publication of this announcement allows the provincial administration to move forward with the cleaning of public spaces and the management of urban waste, while guaranteeing vehicle owners the possibility to file claims and defend their rights before a final decision is made regarding their destination.
