Ribeira calls for those interested in the OGMIOS grant for the municipal library

The City Council of Ribeira summons the interested parties in the contentious-administrative appeal processed as ordinary procedure PO 270/2026, filed by OGMIOS PROYECTO S.L. against the penalty of 51,225.62 euros, the execution of the definitive guarantee, and the termination of the works contract for the new municipal library. The Mayoral Decree of September 18, 2026, signed by the acting mayor Vicente Mariño de Bricio, was published in the Official Gazette of the Province of A Coruña number 182, of September 23, 2026, under announcement number 2026/6080.

The Court of First Instance, Contentious-Administrative Section, Plaza número 1 of Santiago de Compostela sent an official letter to the City Council of Ribeira ordering it to send the administrative file and carry out the summons of all persons appearing as interested parties in the procedure. The municipal resolution is agreed upon under article 49 of Law 29/1998, of July 13, regulating the contentious-administrative jurisdiction, and affects all resolutions issued in the contractual file 2022/C-OB000021.

The three contested administrative acts

The appeal by OGMIOS PROYECTO S.L. is directed against the dismissal by administrative silence of the appeals for reconsideration filed against three municipal decisions:

• Imposition of penalties: Mayoral Decree of September 24, 2024, which imposed a penalty of 51,225.62 euros on the company, equivalent to 5% of the contract price, VAT excluded. An appeal for reconsideration was filed on October 8, 2024, with entry registration number 202400025322, without an express resolution.
• Execution of the definitive guarantee: Mayoral Decree of September 30, 2024, which agreed to execute the amount of 51,225.62 euros from the guarantee provided by Banco Santander S.A. as the definitive guarantee of the contract. An appeal for reconsideration was filed on October 8, 2024, with entry registration number 202400025323, without an express resolution.
• Termination of the contract: Mayoral Decree of December 9, 2024, which declared the works contract “Reform and expansion of existing building for the new municipal library of Ribeira” terminated, as the penalties reached a multiple of 5% of the contractual price. An appeal for reconsideration was filed on January 13, 2025, with entry registration number 202500000875, without an express resolution.

The appearance period

The summons is notified for the general knowledge of all persons interested in the procedure, who have a period of 9 (nine) days counting from the day following the publication of the resolution in the Official Gazette of the Province to appear as a party.

The resolution warns that, should they appear outside the indicated period, they will be considered a party to the proceedings that have not precluded, and that, should they fail to appear in a timely manner, the processing of the procedure will continue without the obligation to send them any notification, in accordance with articles 49 and 50 of Law 29/1998, of July 13.

The contract for the new municipal library

The dispute originates from the works contract for the renovation and expansion of an existing building intended for the new municipal library of Ribeira, the execution of which led to the imposition of penalties and, finally, to the contractual termination.

The Mayoral Decree of December 9, 2024, already anticipated the provision to determine the damages and losses caused and to process the eventual prohibition of the company from contracting, matters that now fall under the control of the Court of First Instance of Santiago de Compostela.

The publication of this summons is relevant for the bidders who participated in the file and for the residents of Ribeira, because it opens the door for third parties with a legitimate interest to appear in the judicial procedure. The validity of the penalty of 51,225.62 euros, the execution of the guarantee from Banco Santander S.A., and the resolution of the contract for the new municipal library—a reference cultural infrastructure for the municipality—depend on the outcome of PO 270/2026.
