Hydraulic concession revoked in the Barranco de Balito de Mogán

The Insular Water Council of Gran Canaria has initiated a hearing process for the extinction by revocation of the administrative concession for the occupation of hydraulic public domain lands of the Barranco de Balito, in the municipality of Mogán, due to the breach of the conditions set forth in the concession document. The decision is published in the Official Gazette of the Canary Islands number 182, dated September 10, 2026, via an announcement dated August 28, 2026 (official reference: announcement 3221, file 477-OCP).
The ownership of the concession belongs to the commercial entities Unión Guanche Catalana, S.A. and Don Paco, S.A., who now have a period of fifteen days, starting from the date of publication, to present allegations and justifications.
Initiation of the procedure
The procedure was initiated by Decree No. 2026-0497, dated August 26, 2026, signed by the Vice President of the Insular Water Council of Gran Canaria. The objective is to declare the concession extinct, by revocation, as the breach of the conditions specified in the concession document has been verified.
The processing is supported by Article 85 of Law 12/1990, of July 26, on the Waters of the Canary Islands, in relation to Articles 114 and 117 of Decree 86/2002, of July 2, which approves the Hydraulic Public Domain Regulations.
Deadline and hearing process
Pursuant to Article 114.3 of the aforementioned regulation, the holders are granted a hearing process so that, within fifteen days from its publication in the official gazette, they may state in writing whatever they deem appropriate regarding their rights and provide the relevant documents and justifications.

The announcement, dated in Las Palmas de Gran Canaria on August 28, 2026, is signed by the Vice President, Miguel Antonio Hidalgo Sánchez, exercising the powers delegated by the President via Decree No. 188, of November 3, 2023 (published in the BOP No. 138, of November 15, 2023).
The revocation of this concession in the Barranco de Balito reinforces the control of the public hydraulic domain in Gran Canaria, within a context of increasingly demanding management of the island’s water resources. The final resolution of the proceedings will determine the fate of the occupied lands and their possible reversion to public use, with direct implications for water planning in the municipality of Mogán.
