Legal appeal against the OARGT regarding the selective tests for nine positions
Por FactBox Admin

The Contentious-Administrative Court No. 1 of Cáceres is processing the abbreviated procedure 181/2026 at the request of Miguel Ángel Gómez Pérez, a candidate challenging the dismissal of his administrative appeal (recurso de alzada) against the selective tests of the Autonomous Body for Tax Collection and Management (OARGT) of the Provincial Council of Cáceres. The Official Gazette of the Province of Cáceres published on Tuesday, October 13, 2026, in issue number 196, the announcement summoning potential interested parties to appear in the proceedings (CVE BOP-2026-4769).
The announcement, signed in Cáceres on October 6, 2026, by the secretary of the body, Miguel Rodríguez Ramos, complies with the court’s requirement and details the chain of challenged administrative acts. The appeal is directed against the resolution of the president of the OARGT dated August 12, 2026, which dismissed the administrative appeal filed by the candidate via a written submission on May 21, 2026, and supplemented on June 6, 2026.
That administrative appeal was, in turn, filed against the agreement of May 19, 2026, of the Selection Board of the selective tests. The call for applications stems from the presidential resolution of December 16, 2024, published in the Official Gazette of the Province of Cáceres No. 242, of December 17, 2024, and was modified by the presidential resolution of July 30, 2025 (BOP No. 146, of August 1, 2025), which approved the final answer key for the multiple-choice exam.
The positions at stake and the framework of the call
The call affected by the litigation is not a minor process: it concerns the filling of nine positions in the General Administration Scale, Administrative Subscale, Auxiliary Class, Group C, Subgroup C2, of the civil service staff of the OARGT of the Provincial Council of Cáceres. The chosen selection system was the competitive examination (concurso-oposición), within the general framework of the execution of public employment offers from several fiscal years.
The essential elements of the process are as follows:
- Nine positions in the General Administration Scale, Administrative Subscale, Auxiliary Class, Group C, Subgroup C2.
- Selection system: competitive examination (concurso-oposición).
- Destination: civil service staff of the OARGT of the Provincial Council of Cáceres.
- Execution framework: Public Employment Offers of 2021, 2022, 2023, and 2024.
- Call for applications: presidential resolution of December 16, 2024 (BOP No. 242, of December 17, 2024).
- Modification: presidential resolution of July 30, 2025 (BOP No. 146, of August 1, 2025), containing the final answer key for the multiple-choice exam.
The summons and the deadline for appearance
The announcement summons those who may have the status of interested parties to appear and present themselves before the Court of First Instance, Contentious-Administrative Section, Plaza n.º 1 of Cáceres, in relation to summary proceeding 181/2026. The deadline is nine days starting from the day following the publication of the announcement, in accordance with the provisions of Article 49 of Law 29/1998, of July 13, regulating the Contentious-Administrative Jurisdiction.
The text warns of the consequences of acting outside the deadline: anyone who appears late will be considered a party only for the proceedings that have not yet expired. And if they do not appear in a timely manner, the proceedings will continue through their stages without any notifications of any kind being issued, neither by court notice nor by any other means.
Chronology of the conflict
The sequence of acts that has led to the court can be ordered as follows:
- December 16, 2024: presidential resolution convening the selective tests (BOP n.º 242, of December 17, 2024).
- July 30, 2025: presidential resolution approving the final answer key for the multiple-choice exercise (BOP n.º 146, of August 1, 2025).
- May 19, 2026: agreement of the Selection Board of the selective tests.
- May 21, 2026: appeal for reversal (recurso de alzada) filed by the applicant, supplemented on June 6, 2026.
- August 12, 2026: resolution of the president of the OARGT dismissing the appeal.
- October 6, 2026: signing of the summons announcement by the secretary of the organization.
- October 13, 2026: publication of the announcement in the BOP of Cáceres n.º 196 (CVE BOP-2026-4769).
Impact for candidates and for the Provincial Council
The relevance of the case is twofold. For the candidates who participated in the process, the litigation opens the door to a potential judicial review of the final answer key of the multiple-choice exercise and, consequently, of the results of the competitive examination phase. For the Provincial Council of Cáceres and its OARGT, the risk is that a favorable judgment may force the reversal of proceedings or the repetition of part of the selection process, with the resulting delay in filling the nine positions and in the execution of the committed public employment offers.
