Recurso contencioso contra las oposiciones de Cuerpo Auxiliar de Extremadura

The General Directorate of Public Service of the Regional Government of Extremadura has agreed to the referral of the administrative file of the contentious-administrative appeal processed as ordinary procedure no. 410/2026 before the Contentious-Administrative Chamber of the High Court of Justice of Extremadura, and summons potential interested parties to appear within a period of nine days. The decision is published in the Official Gazette of Extremadura (DOE) no. 192, of October 5, 2026, by means of the Resolution of September 23, 2026 (official reference 2026062466). The litigation directly affects the selective tests of the Auxiliary Corps, General Administration Specialty, of the regional administration.

The appeal was filed by the legal representation of Ms. María Montaña Crespo Garrido, against the dismissal of the administrative appeal (recurso de alzada) that she had submitted on July 14, 2026. The challenged administrative acts are the agreements issued on June 29 and 30, 2026, by the Selection Tribunal no. 7, the body responsible for evaluating the selective tests for access to vacant civil servant positions of the aforementioned corps. The call for these tests was approved by Order of December 23, 2024 (DOE no. 250, of December 27).

The summons and its deadlines

The resolution complies with the request made by the Chamber itself and orders the referral of the administrative file, so that those with a legitimate interest in the procedure may appear before the court if it is in their legal interest. The period is nine days, counted from the day following the publication of the resolution in the DOE.

The regulation warns of the consequences of acting out of time: anyone who appears once this period has elapsed will be considered a party only for the non-precluded proceedings, the procedure will continue through its stages, and no notifications will be made to them in court or by any other means.

The challenged acts and the call

The object of the litigation is specified in the following elements:

  • Ordinary procedure no. 410/2026, before the Contentious-Administrative Chamber of the High Court of Justice of Extremadura.
  • Appellant: Ms. María Montaña Crespo Garrido, through her legal representation.
  • Prior act: dismissal of the administrative appeal of July 14, 2026.
  • Challenged acts: agreements of June 29 and 30, 2026, of the Selection Tribunal no. 7.
  • Selection process: vacant civil servant positions of the Auxiliary Corps, General Administration Specialty, called by Order of December 23, 2024 (DOE no. 250, of December 27).

The resolution is based on Articles 48 and 49 of Law 29/1998, of July 13, regulating the Contentious-Administrative Jurisdiction, which govern the summoning of interested parties in the contentious-administrative process. The act is signed by the Director General of Public Service, Hugo Alfonso Curiel Rodríguez, in Mérida on September 23, 2026, and falls under the Ministry of Finance, Public Administration and Social Dialogue.

Publication in the DOE is the formal channel through which the summons acquires general effectiveness, as the procedure affects an indeterminate group of applicants from the same call and not only the appellant.

Impact for candidates

The news has an immediate effect on all participants in the tests for the Auxiliary Corps, General Administration Specialty called in December 2024: the nine-day period is peremptory and its calculation begins the day after publication. Those who do not appear within that timeframe will be bound by the result of the procedure without receiving additional notifications, while those who do appear may defend their position before the Contentious-Administrative Chamber in a litigation that questions agreements of the Selection Tribunal No. 7 and which, depending on its outcome, may condition the development of the selection process.
