Puerto de la Cruz dissolves the Archaeological Museum Board and assumes its services

The Puerto de la Cruz City Council has finalized the agreement to dissolve the Archaeological Museum Board and integrate the services corresponding to said museum into the municipal corporation. The decision, adopted after no claims were filed during the public exhibition period, is published in the Official Gazette of the Province of Santa Cruz de Tenerife, number 104, dated August 31, 2026, with official reference 1766759 and file 8726/2019.

The agreement was initially approved by the Municipal Plenary on May 25, 2026 and, in accordance with Article 49 of Law 7/1985, of April 2, Regulating the Bases of the Local Regime, it is automatically finalized as no claims or suggestions were submitted. The dissolution is justified by a change in the management method based on principles of efficacy and efficiency.

Integration of services and heritage

The agreement, contained in Decree number 2026-0901, dated August 26, 2026, provides for the dissolution of the Board and the integration of the museum’s services into the City Council. The assets forming part of the archaeological heritage, as well as all other assets of another nature, shall remain in the same premises where they are currently located, with the City Council being the universal successor to the Board regarding all assets and collections.

• The statutes of the Board, approved by plenary agreement on April 26, 1990, are repealed.
• The Board’s current accounts are cancelled, with their balances transferred to the City Council, along with all existing accounting rights and obligations.
• The City Council is subrogated to the ownership of the data files, with notification to the Spanish Data Protection Agency.

Subrogation of workers

The staff providing services at the Archaeological Museum Board will be subrogated in accordance with Article 44 of the consolidated text of the Workers’ Statute Law, effective at the moment of final dissolution. The Puerto de la Cruz City Council assumes the position of employer regarding the workers, and must make the corresponding adjustments both to the Staffing and the Job Position List.

The agreement also contemplates channeling the participation of the Institute of Hispanic Studies in the operation and decision-making affecting the museum, and may include the presence of other institutions, professionals, or bodies of local, island, and regional scope.

Communication and appeals

Notice of the dissolution agreement shall be given to the General State Administration, the Autonomous Community of the Canary Islands, the Insular Council of Tenerife, Social Security, and other relevant bodies, as well as the Historical Heritage Council of the Canary Islands, the highest advisory and consultative body of the Canarian public administrations regarding historical heritage. The agreement shall be published in the official bulletin and on the notice board of the City Council’s Electronic Office.

Against the agreement, interested parties may directly file a contentious-administrative appeal in the manner and within the timeframes established in articles 25 to 42 of Law 29/1998, of July 13, regulating said jurisdiction.

The dissolution of the Board implies a relevant change in the management of the archaeological heritage of Puerto de la Cruz, which will now depend directly on the municipal administration, with guarantees of continuity for the assets, the collections, and the employment of the museum workers.
