Pozanco takes over Sustainability and Environment and will chair the Botanical Garden

The Mayor of Córdoba has delegated to Councilor María Encarnación Pozanco López the municipal powers regarding Sustainability and the Environment, as well as the presidency of the Governing Council of the Municipal Institute of Environmental Management (IMGEMA) “Royal Botanical Garden of Córdoba”. The decision is formalized through Decree No. 16048, issued on September 18, 2026, and published in the Official Gazette of the Province of Córdoba No. 185, corresponding to Thursday, September 24, 2026, in the Local Administration section (reference BOP-A-2026-3195).

The legal framework of the delegation

The decree is based on Article 124.4 b) of Law 7/1985, of April 2, regulating the Bases of Local Regime (LRBRL), which empowers the mayor to direct municipal policy, government, and administration. The same provision, in letter k, authorizes the mayor to establish the organization and structure of the executive municipal Administration, without prejudice to the competencies of the Plenary regarding organization.

The text recalls that the Plenary, in a session held on June 12, 2025, approved the General Organic Regulation, whose Article 168 structures the Córdoba City Council into Government Areas. These areas, which may not exceed ten, integrate the various municipal services, decentralized management bodies, and public companies, and it is the responsibility of the Mayor’s Office to determine their number, name, and powers.

Within each Government Area, Delegations must be defined, understood as scopes of government competencies of a homogeneous nature or with coordination relationships. The decree also invokes Article 124.5 of the LRBRL, which allows the Mayor’s Office to delegate the exercise of its powers with the exceptions provided for in the regulation.

What is delegated and to what extent

The provisions of Decree No. 16048 are articulated in four sections:

• First: delegation in favor of Councilor María Encarnación Pozanco López of the powers regarding Sustainability and the Environment.
• Second: delegation to the same councilor of the Presidency of the Governing Council of IMGEMA “Royal Botanical Garden of Córdoba”.
• Third: express revocation of any other delegation of powers from the Mayor’s Office that may exist insofar as it contradicts these provisions.
• Fourth: entry into force from its approval, without prejudice to its notification to the interested parties.

The motivation for the decree is the swearing-in as councilor of María Encarnación Pozanco López, which necessitates the reorganization of the Mayor’s Office delegations in the environmental field.

Notification, acceptance, and publicity

The decree specifies that the delegation shall be notified to the interested parties, requesting their acceptance, which shall be understood as tacitly granted if no contrary statement is made within three days. The text orders its publication in the Official Gazette of the Province, on the Transparency Portal of the Córdoba City Council, and its communication to the Local Government Board and the Corporate Plenary, at the first session held by said bodies.
