Ponte Caldelas orders biomass clearing in five plots to fight fire

The Ponte Caldelas City Council has ordered the cleaning of biomass in five plots within the municipality due to the risk of forest fires. The resolution, signed by Mayor Andrés Díaz Sobral, was made public in the Official Gazette of the Province of Pontevedra (BOPPO) on October 14, 2026, number 198, via an announcement dated October 7, 2026. Affected owners have a period of 15 calendar days to carry out the work voluntarily.

The announcement is processed in accordance with articles 44 and 46.1 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations, after individual notification proved unsuccessful for reasons not attributable to the Administration. The communication refers to number 2 of article 22 of Law 3/2007, of April 9, on the prevention and defense against forest fires in Galicia.

According to the published text, the requirements established in article 21 of Law 3/2007 are not being met in the listed plots. Article 22.3 of the same regulation provides that, when the identity of the responsible person cannot be determined or notification proves unsuccessful, the communication shall be made via an announcement in the Official State Gazette and the Official Gazette of Galicia with the cadastral data of the plot.

Five files distributed across four parishes

The list of execution orders includes five files, with initiation resolutions issued between September 14 and October 6, 2026:

• File 1671-2026: plot 36043A043007370000JO, polygon 43, plot 737, in the parish of A Insua; responsible person Marlene Rivas Gonzalez; initiation resolution of 14.09.2026.
• File 1579-2026: plot 36043A039000830000JG, polygon 39, plot 83, in Chain–A Insua; responsible Maria del Carmen Orge Cal; resolution of 15.09.2026.
• File 1802-2026: plot 36043A028018190000JT, polygon 28, plot 1819, in Pazos; responsible Avelino Fernández González; resolution of 18.09.2026.
• File 1858-2026: plot 36043A028012830000JM, polygon 28, plot 1283, in Pazos; responsible Victoria Teijeiro Martinez; resolution of 29.09.2026.
• File 1082-2026: plot 36043A008002050000JS, polygon 8, plot 205, in Forzans; responsible Marcelino Alvaro Blanco; resolution of 06.10.2026.

15-day deadline and subsidiary execution

The maximum period for voluntary compliance is 15 calendar days, which will begin the day following the receipt of the notification. The publication in the provincial gazette serves as notification to the interested person, who may consult the file at the Ponte Caldelas City Council, at Avenida de Galicia, 17, 36820 Ponte Caldelas, or on the entity’s electronic headquarters.

Article 22.4 of Law 3/2007 empowers the council to carry out subsidiary execution in case of non-compliance with the works, passing the costs on to the responsible parties. For its part, article 22.6 establishes the obligation of the responsible parties to facilitate the necessary access to the entities in charge of management, which will not require authorization to act within the management strip networks.

Precedent of subsidiary executions in September

On September 18, 2026, the municipality had already published in BOPPO number 180 two subsidiary execution orders on the same matter, with passed-on costs of 360.00 euros (file 1176-2026, parish of A Roca–A Insua) and 720.00 euros (file 967-2026, A Fraga–Caritel).

For the residents of Ponte Caldelas, the announcement serves as a direct warning: those who do not clean their plots within the fixed period may see the council execute the works on its own account and send them the bill, in addition to assuming the obligation to facilitate access to the crews. The measure is part of the annual fire prevention campaign in the province of Pontevedra, where biomass management in safety strips is decisive for reducing the risk of fire.
