Ponte Caldelas collects 360 and 720 euros for biomass in two plots

The Ponte Caldelas City Council has notified by edict the subsidiary execution of vegetable biomass management in two plots in the municipality, located in A Insua and Caritel, after communication to the responsible persons proved unsuccessful. The costs charged amount to 360.00 euros and 720.00 euros, according to the announcement published in the Official Gazette of the Province of Pontevedra (BOPPO) number 180, dated September 18, 2026. The document is dated September 11, 2026, and is signed by the mayor, Andrés Díaz Sobral.

The publication is included in the Local Administration section, within the “Other documents, notifications and public information” category, and responds to the impossibility of carrying out the communication provided for in article 22.2 of Law 3/2007, of April 9, on the prevention and defense against forest fires in Galicia. Article 22.3 of the same regulation provides that, when the identity of the responsible person cannot be determined or the notification proves unsuccessful, the communication shall be made by means of an announcement in the Official State Gazette and the Official Gazette of Galicia with the cadastral data of the plot.

Two plots, two files

The list of affected plots includes two subsidiary execution files:

• File 1176-2026: plot in A Roca – A Insua, polygon 36, plot 239, with cadastral references 36043A036002390000JH and 36043A036002390001KJ. The responsible person is Herminda Martinez Vaqueiro and the cost of the subsidiary execution was set at 360.00 euros. The execution order was resolved on August 21, 2026.
• File 967-2026: plot in A Fraga – Caritel, polygon 9, plot 211, cadastral reference 36043A009002110000JI. The responsible person is Elena Lorenzo Barreiro and the cost amounts to 720.00 euros. The execution order is dated September 8, 2026.

The legal basis of the action

The announcement invokes articles 44 and 46.1 of Law 39/2015, of October 1, on the common administrative procedure of public administrations, to publish the notification when it cannot be carried out for reasons not attributable to the Administration. Fundamentally, the action is based on article 22 of Law 3/2007, of April 9, on the prevention and defense against forest fires in Galicia.

As stated in the edict itself, article 22.4 of Law 3/2007 enables the council to subsidiarily execute biomass management works in case of non-compliance and charge the costs to the responsible persons. Article 22.6 further establishes the obligation of the responsible parties to facilitate access to the entities in charge of the works, which do not require authorization to act within the management strip networks.

For the residents of A Insua and Caritel, the edict is a reminder that biomass management is a legal obligation whose non-compliance results in passed-on costs and the direct intervention of the local Administration.
