Ponferrada aplaza el examen de ingeniero industrial tras estimar un recurso

The Ponferrada City Council has suspended the first exercise of the selection process to fill a position for an Industrial Technical Engineer, which was scheduled for October 22, 2026, at 11:30 a.m. The decision was made by the Delegated Department of Finance, Internal Regime, and Procurement and published in the Official Gazette of the Province of León no. 202, dated October 23, 2026, under official reference BOP-LE-2026-202005. The call for applications thus remains without a scheduled date.

The position is for a civil servant and is called via a competitive examination system (concurso-oposición) in the open category. The resolution of September 2, 2026, published in the BOP on September 3, had approved the final list of admitted and excluded persons, named the qualifying board, and set the first exercise of the opposition phase for October 22 at 11:30 a.m. in Classroom 20, located on the ground floor of El Toralín municipal football stadium.

The postponement stems from a letter dated August 31, 2026, submitted by M Reyes Vega Mata (DNI *0179), a candidate in the process, who filed an optional appeal for reversal against the municipal resolution of August 6, 2026. That resolution approved the provisional list elevated to final, the appointment of the board, and the start date; the appeal specifically challenged the composition of the selection body due to the absence of a degree holder in a specialty equivalent or superior to the advertised position and the appointment of the president without specialized technical training.

Partial approval and new board

The resolution from the Mayor’s Office dated October 14, 2026, admits and resolves the appeal, partially granting the candidate’s claim, and agrees to the appointment of a new board. The change affects one person with the category of titular member and the person with the category of titular president.

This agreement was sent to the publications service of the Official Gazette of the Province of León, but, according to the published text, as of the date of the resolution now disseminated, it had not been published “as is required.”

The board cannot be constituted

The City Council reasons that selection processes are governed by the principles of publicity, merit, and capacity, as set out in Articles 22.3 and 103 of the Constitution. It adds that, since the announcement of the resolution of October 14, 2026, had not been published in the BOP to take effect, the qualifying board “cannot be constituted in the legally established manner.”

For that reason, it is considered appropriate to postpone the start of the selection process “until the resolutions affecting it are published in the official gazettes.” The authority to resolve this corresponds to the delegated councilor, in accordance with Article 123.1 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations.

What the resolution agrees

  • To suspend the second operative point of the resolution of the Delegated Department of September 2, 2026 (BOP 3.9.2026), which set the first exercise for October 22, 2026, at 11:30 a.m.
  • To postpone the celebration “to a date to be determined,” once the publications in the BOP regarding the new appointments of the qualifying tribunal have been corrected.
  • To publish the resolution on the corporate website and send it to the Official Provincial Gazette for its knowledge and effects.
  • To issue, once the procedures have been corrected, a new resolution setting the day, time, and place for the start of the selection process, which will be published in the BOP of León and on the municipal website.

The resolution is signed by the delegated councilor Luis Antonio Moreno Rodríguez, before the general secretary Concepción Menéndez Fernández.

No administrative appeal

The text warns that against the future resolution setting the new date, as a procedural act and in accordance with Article 112 of Law 39/2015, no appeal may be filed through administrative channels. The process is not annulled: it is interrupted until the appointments of the tribunal are published in the official gazette.

The postponement leaves in limbo both the filling of the vacant position in the municipal staff and the situation of the admitted persons, who had been summoned for October 22 and now do not know when they must take the exam. The resolution does not set a deadline for the new call: the condition is the publication of the new tribunal appointments in the BOP, so the date of the exam will depend on the timing of the Provincial Council’s publication service.
