Technical Report of Huesca issues favorable ruling with conditions for children's playroom

The Technical Committee on Activities of the Hon. City Council of Huesca has issued a favorable opinion with conditions for the granting of the environmental license for the classified activity of a children’s playroom, requested by Alberto Comín Rubio. The agreement, adopted on August 4, 2026, was published this Monday, August 17, in the Official Bulletin of the Province of Huesca, number 155, under the official reference BOPH-2026-155002. The opinion is valid for two years from its publication.

The activity will be located in the building at Calle Joaquín Costa, number 24 in the Huesca capital, with cadastral reference 4191021YM1648G0001JO. The Committee has classified the children’s playroom as an activity that is a nuisance due to noise, vibrations, and air emission from the premises’ air conditioning and ventilation, and therefore requires compliance with a series of corrective prescriptions before it can operate.

Regulatory framework and procedure

File number 3685 has followed the procedure provided for in articles 75 to 80 of Law 11/2014, of December 4, on Environmental Prevention and Protection of Aragon, and has been processed in accordance with the Order of the Department of Urban Planning, Public Works and Transport of the Government of Aragon of November 28, 1986. The favorable classification with conditions implies that the business may only operate if it fully complies with the conditions imposed by the municipal technical body.

Required corrective measures

Among the obligations that the applicant must assume before starting the activity are:

• Installation of acoustic insulation against airborne noise, as well as anti-vibration elements to mitigate the emission of vibrations to the surroundings.
• Provision of ventilation, air conditioning, fire extinguishers, emergency lighting, and adequate signage.
• Compliance with the acoustic quality objectives established in municipal ordinances and in Law 7/2010, of November 18, on protection against acoustic pollution in Aragon.
• Accreditation of the communication regime or authorization for commissioning of the low-voltage electrical installation before the Provincial Service of Industry and Innovation or an Authorized Control Body.
• Compliance with the discharge limits to the municipal sewer system in accordance with Decree 38/2004, of February 24, of the Government of Aragon.
• Compliance with the food hygiene rules of Regulation (EC) No. 852/2004 of the European Parliament and of the Council, of April 29, 2004.
• Taking out civil liability insurance in accordance with the maximum occupancy of the premises, in compliance with Decree 13/2009 of the Government of Aragon.

Safety and accessibility requirements

The opinion also establishes specific safety and accessibility conditions that must be remedied:

• The premises must have a storage area with a minimum surface area of 4 square meters.
• There may not be any locking device on the exit door that obstructs evacuation during the exercise of the activity.
• The separation door with the dining area may only be operated by the owner when no activity is taking place inside.
• The existing access ramp, currently without a landing, is not admissible. The installation of manual doors without horizontal space is permitted provided that a call bell, signposted and accessible from a wheelchair, is installed at the starting point.

Pending steps for opening

The Committee warns that, in accordance with Law 11/2005, the activity may not begin until the corresponding operating license is obtained, the application for which must be submitted once the adaptation works have been completed. In addition, the Huesca City Council must communicate the adopted resolution to the Provincial Environment Commission within three days following the granting of the municipal license.

This is a new family leisure business that will join the offering of the city of Huesca, subject to strict environmental control to reconcile recreational activity with the tranquility of the surroundings.
