Planes allocates 100 square meters for a multi-operator mobile antenna

The Planes City Council has approved the public domain concession for the private use of a 100-square-meter plot located within the public domain of the old cemetery, intended for the maintenance, modification, and expansion of a multi-operator mobile telecommunications network infrastructure. The decision was adopted via Mayoral Resolution No. 282/2026, dated September 15, 2026, and is published in the Official Gazette of the Province of Alicante (BOP) No. 179, dated September 21, 2026.

The announcement is disseminated for general knowledge in compliance with Article 8.1.a) of Law 19/2013, of December 9, on transparency, access to public information, and good governance. The file for the concession of private use of the public domain asset was approved by the local governing body and signed by the mayor, Francisco Javier Sendra Mengual, in Planes on September 15, 2026.

The plot and its location

The object of the concession is a portion of land measuring 100 square meters located within the public domain of the old cemetery, identified by the following data:

• Area: 100 square meters.
• Location: PD Cementeri Vell 1, within the public domain of the old cemetery.
• Cadastral reference: 0203801YH3906S0001KJ.
• Purpose: maintenance, modification, and/or expansion of a multi-operator mobile telecommunications network infrastructure within the leased space.

Term and scope of the concession

The concession is granted for a period of 10 years, as stated in the award notice. The declared purpose is a multi-operator mobile telecommunications network infrastructure, which allows the installation to serve several companies on a single infrastructure within the leased space.

The private use of this public domain asset is formalized through the file processed by the Planes City Council, whose announcement is titled the award of the public domain concession for the private use of the public domain plot PD Cementeri Vell 1.

Publicity and means of appeal

The resolution that ends the administrative process may be challenged through two alternative routes:

• Optional appeal for reversal (recurso de reposición) before the Mayor’s Office of the Planes City Council, within a period of one month, in accordance with Articles 123 and 124 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations.
• Contentious-administrative appeal before the Contentious-Administrative Court of Alicante, within a period of two months, in accordance with Article 46 of Law 29/1998, of July 13, of the Contentious-Administrative Jurisdiction.

If the optional appeal for reversal (recurso de reposición) is chosen, the contentious-administrative appeal may not be filed until the former is expressly resolved or has been dismissed by silence, without prejudice to any other appeal deemed more appropriate.

The publication of the award allows residents and operators to know the conditions for the deployment of mobile coverage in the municipality. The 10-year grant of publicly owned land for a multi-operator infrastructure opens the door to improving mobile telephony service in the area, while subjecting the use of public domain to the deadlines and channels for challenge provided for in administrative regulations.
