Pereiro de Aguiar demands the cleaning of four plots in Bouzas de Fondo

The City Council of O Pereiro de Aguiar published a notice of notification by appearance in the Official Gazette of the Province of Ourense on September 8, 2026, addressed to four plot owners in the area of Bouzas de Fondo, requiring them to manage plant biomass and remove prohibited tree species from their lands, in application of forest fire prevention regulations. The notice, signed by Mayor Luís Menor Pérez, warns that non-compliance may result in coercive fines of €900 per hectare and the subsidiary execution of the works.

The notification is part of file 1045/26 and is processed by appearance because it was not possible to notify the interested parties personally, for reasons not attributable to the Administration, in accordance with Article 44 of Law 39/2015, of October 1, on the common administrative procedure of public administrations.

Affected owners and plots

The list of plots and interested parties affected by the file includes four cadastral owners, all located in the area of Bouzas de Fondo, in the municipality of O Pereiro de Aguiar:

• José Eulogio Lorenzo Doallo, cadastral reference 32059A01400052, in Bouzas de Fondo/Bodeguiñas.

Deadline and consequences of non-compliance

The owners, or their legal representatives, have a non-extendable period of 15 business days, counted from the day following the publication of the notice in the Official State Gazette (BOE), to voluntarily comply with the biomass management obligation.

If the cleaning tasks are not carried out after this period, the council may adopt several measures:

• Impose coercive fines of €900.00 per hectare of unmanaged plot, or the proportional amount if the area is smaller, with a fixed minimum of €100.00.
• Initiate sanctioning proceedings.
• Proceed with the subsidiary execution of the works, the costs of which will be fully charged to the owner of the plot.

The document was electronically signed by the mayor.

The measure is incorporated into the municipal forest fire prevention policy, which requires landowners to keep plots free of biomass and prohibited tree species, especially in urban-forest interface zones such as Bouzas de Fondo. The combination of coercive fines and subsidiary execution seeks to ensure that the cleaning is carried out effectively, transferring the full cost of the works to the owners in the event that they do not comply voluntarily.
