Pereiro de Aguiar requires four owners to clear biomass

The City Council of O Pereiro de Aguiar publishes in the Official Gazette of the Province of Ourense on September 8, 2026, a notification by appearance addressed to four owners of plots in the area of Bouzas de Fondo, so that they manage the plant biomass and remove prohibited tree species from their lands. The announcement, signed by Mayor Luís Menor Pérez, warns of coercive fines of €900/ha and the subsidiary execution of the works in case of non-compliance.

The notification is processed within the framework of file 1045/26, regarding the prevention of forest fires, and complies with Article 44 of Law 39/2015, of October 1, on the common administrative procedure, as personal notification was not possible for reasons not attributable to the Administration.

The four affected owners

The list of plots and interested parties included in the announcement covers four cadastral references in the Bouzas de Fondo and Bodeguiñas area:

Deadline and consequences of non-compliance

The interested parties, or their legal representatives, have a non-extendable period of 15 business days, counted from the day following the publication of the announcement in the Official State Gazette (BOE), to voluntarily comply with the biomass management obligation.

If the cleaning tasks are not carried out after this period, the council may:

Impose coercive fines of €900.00 per hectare of unmanaged plot, or the proportional amount if the area is smaller, with a fixed minimum of €100.00.
Initiate a sanctioning procedure.
Proceed with the subsidiary execution of the works, the costs of which will be fully charged to the owner of the plot.

To know the full content of the administrative act, interested parties may appear at the offices of the Urban Planning Service of the council, at Praza do Concello, no. 1, O Pereiro de Aguiar, from 09:00 to 14:00 hours, Monday to Friday. The document is electronically signed.

The measure reinforces the legal obligation to keep plots free of biomass and fire-prone species in a region with a high risk of fire, and serves as a direct warning to owners that the local Administration is prepared to act ex officio, passing the cleaning costs on to the owners who do not comply.
