Peru puts the technical regulation for circuit breakers out for public consultation

The Ministry of Production has arranged for the publication of the draft “Supreme Decree approving the Technical Regulation on automatic overcurrent circuit breakers for residential, commercial, and similar installations” and its annexes, through R.M. N° 00315-2026-PRODUCE, signed in Lima on September 4, 2026, and published in the official newspaper El Peruano on Tuesday, September 8, 2026. The regulation opens a period of 90 calendar days for public and private entities, as well as citizens, to submit comments, contributions, or opinions on the text.

The resolution, signed by Minister Juan Carlos Requejo Alemán, falls within the competencies that the Law of Organization and Functions of the Ministry of Production (Legislative Decree No. 1047) grants the sector regarding industrial standardization and the regulation of supervised products. The project is further based on the Law on Labeling and Verification of Technical Regulations for Manufactured Industrial Products (Legislative Decree No. 1304), which empowers the ministry to supervise, inspect, and sanction compliance with technical regulations.

Purpose of the technical regulation

The project establishes the technical safety and labeling specifications that low-voltage automatic circuit breakers intended for overcurrent protection in residential, commercial, and similar installations must meet. These requirements will be mandatory and will apply during the production, import, and commercialization stages of these devices.

The initiative responds to international commitments assumed by Peru before the World Trade Organization (WTO) and the Andean Community (CAN), which recognize the authority of countries to adopt technical regulations to safeguard the health, safety, and lives of people, as well as to prevent practices that may mislead consumers.

Citizen participation mechanism

During the 90-day consultation period, interested parties may submit their observations through the following channels:

• The digital headquarters of the Ministry of Production (www.gob.pe/produce), where the project will remain published from the same day the resolution was published in El Peruano.
• The ministry’s Filing Office (Mesa de Partes), located at Calle Uno Oeste N° 060, Urbanización Córpac, San Isidro district, Lima, addressed to the General Directorate of Policies and Regulatory Analysis of the Vice-Ministerial Office of MYPE and Industry.
• The email address dn@produce.gob.pe.

The period is calculated starting from the day following the publication of the resolution in the official gazette, in line with the provisions of Supreme Decree No. 009-2024-JUS and Supreme Decree No. 149-2005-EF, which regulates the publication of draft technical regulations affecting the trade of goods and services.

Scope and impact

The measure will directly affect manufacturers, importers, and marketers of low-voltage circuit breakers, who must adapt their products to the new safety and labeling specifications once the regulation is approved by supreme decree. For consumers, it provides a greater guarantee against electrical risks in homes and commercial premises, while preventing the marketing of devices that do not meet technical standards.

The public consultation constitutes the previous step to the final approval of the regulation, which must be endorsed by the Ministry of Economy and Finance and by the involved sector, in accordance with current regulations on restrictions to the free flow of goods.
