Peñausende announces the opening for the position of titular Justice of the Peace

The Peñausende City Council has approved the public call to fill the upcoming vacancy for the position of titular Justice of the Peace of the municipality, according to the edict published in the Official Gazette of the Province of Zamora number 100, dated August 28, 2026 (reference R-202602068). Interested residents will have a period of one month, starting from the day following the publication of the edict, to submit their application to the City Council Secretariat.

The decision responds to the letter sent by the High Court of Justice of Castilla y León dated July 10, 2026, communicating the upcoming end of the mandate of the current titular Justice of the Peace and requesting the Council to choose the suitable person willing to accept the position within a period of three months.

Regulatory Framework

The procedure is regulated in articles 101 and 102 of the Organic Law of the Judiciary and in articles 5 and following of Regulation 3/1995, of June 7, on Justices of the Peace, approved by agreement of the General Council of the Judiciary on July 7, 1995. On this basis, the Mayor’s Office has resolved to approve the call, which is based on three criteria.

Requirements and Documentation

Residents of the municipality who meet the legally established conditions and do not fall under the causes of incompatibility provided for in the Organic Law of the Judiciary may apply for the position. The written application must be accompanied by the following documentation:

  • Photocopy of the DNI (National ID).
  • A sworn statement stating that they have not been convicted of an intentional crime or, where applicable, that rehabilitation has been obtained.
  • That they are not being prosecuted or indicted for an intentional crime.
  • That they are in full exercise of their civil rights.
  • That they are Spanish, of legal age, not physically or mentally impaired for judicial function, and will reside in the municipality, unless authorized by the Governing Chamber of the High Court of Justice of Castilla y León.
  • That they are not subject to any of the causes of incapacity, incompatibility, or prohibition provided for in articles 389 to 397 of the Organic Law of the Judiciary.

Processing and Election

The call will be made public by edict in the Official Gazette of the Province and on the City Council’s notice board. Applications submitted within the deadline will be submitted for consideration by the Plenary of the City Council in the first session held, which will choose the suitable person among the interested parties with an absolute majority quorum. The edict is signed by the Mayor’s Office in Peñausende on August 26, 2026.
