Pau corrects the tender for the civic center bar

The Pau City Council has published in the Official Gazette of the Province of Girona (BOPG) the rectification of a material error in the tender announcement for the administrative concession for the private use of the public domain of the bar service at the Pau civic center. The correction, electronically signed by Mayor Jaume Isern Ruiz on August 26, affects the award criteria and the duration of the concession, and is published in BOPG no. 165 of August 27, 2026 (edict 7639, CVE BOP-2026_0_165_7639).
The original announcement was published in BOPG no. 164/0 of August 26, 2026. Upon detecting the error, the City Council applied the procedure provided for in Article 109.2 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations, which allows for the correction of material, factual, or arithmetic errors in administrative acts.
Correction of award criteria
The first error corrected affects the eleventh clause of the specific administrative clauses document (PCA), which sets the criteria evaluable automatically. The maximum number of points has been reduced:
- Where it said: criteria evaluable automatically, up to a maximum of 90 points.
- It should say: criteria evaluable automatically, up to a maximum of 70 points.
This modification reduces the maximum weight of the automatic criteria in the evaluation of offers by 20 points, a relevant change for bidders preparing their proposals.
Extension of the concession duration
The second error corrected affects the duration of the concession, which is extended by two years compared to the figure initially published:
- Where it said: the concession would be granted from October 9, 2026, until October 11 of the year 2028.
- It should say: the concession will be granted from October 9, 2026, until October 11 of the year 2030.
In both cases, the provision remains that the 4-year period counts from the day after the formalization of the administrative contract, so that the start date and nominal duration do not vary, but the final term of the concession does.
Relevance for bidders
The rectification is particularly significant for individuals and companies interested in applying for the management of the Pau civic center bar, as both the scoring scale and the time horizon of the concession directly condition the evaluation of offers and the profitability of the project. Bidders must take into account the corrected version of the announcement when calculating their proposals, both regarding the maximum achievable score and the term of validity of the concession.
