Cultural Heritage notifies by appearance of the sanction of file S-L-61.25

The General Directorate of Cultural Heritage, under the Ministry of Culture, Language and Youth, has notified the resolution of the sanctioning procedure S-L-61.25, processed for an infringement typified in Law 5/2016, of May 4, on the cultural heritage of Galicia. The resolution was issued on July 23, 2026, and is now published in the Official Gazette of Galicia (DOG) no. 179, of September 21, 2026, after it was not possible to carry out personal notification to the interested party.

A notification by appearance

The announcement, signed on September 10, 2026, by the general director of Cultural Heritage, Ángel Miramontes Carballada, summons the interested party to be notified of the administrative act by appearance. The measure is supported by articles 44 and 46 of Law 39/2015, of October 1, on the common administrative procedure of public administrations, which enable notification by public notice when circumstances exist that prevent personal notification.

The appearance must take place within a period of ten business days, counted from the day following the publication of the announcement on the single notice board of the Official State Gazette. The effectiveness of the notification is subject to that publication; once the period has elapsed without appearance, the notification shall be understood as produced from the day following the expiration date.

Location, schedule, and file identification

The interested party must go to the headquarters of the Surveillance and Inspection Service of the General Directorate of Cultural Heritage, located at the San Caetano Administrative Complex, building no. 3, 2nd floor, in Santiago de Compostela. The office hours are from 9:00 to 14:00, Monday to Friday.

Regulatory framework and scope

Law 5/2016, of May 4, regulates the protection, conservation, and dissemination of the cultural heritage of Galicia and typifies infringements in this matter, the instruction of which corresponds to the General Directorate of Cultural Heritage. The announcement does not detail the amount of the sanction nor the specific conduct sanctioned, data which are communicated directly to the interested party during the act of appearance.

The publication is inserted in section VI (Announcements), heading A) Autonomous administration, of the DOG, on page 49750.

Relevance

Notification by public notice ensures that the sanctioning procedure can continue and reach finality even if the Administration cannot locate the interested party, preventing the resolution from becoming ineffective due to reasons unrelated to the file. For those affected, the ten-business-day period is the only window to learn the content of the resolution and, if applicable, file an appeal.
