OECE appoints Villanueva Sandoval as president of the Public Procurement Tribunal

The Specialized Body for Efficient Public Procurement (OECE) formalized the appointment of Víctor Manuel Villanueva Sandoval as President of the Public Procurement Tribunal (TCP), the resolving body that handles disputes arising from state procurement nationwide. The measure was officialized through Executive Presidency Resolution No. D000289-2026-OECE-PRE, signed in Jesús María on September 25, 2026, and published in the Official Gazette El Peruano on Monday, September 28, 2026, within the Specialized Technical Bodies section. The resolution reflects the agreement adopted unanimously by the body’s Board of Directors.

A Unanimous Agreement of the Board of Directors

The origin of the appointment lies in the Board of Directors Session No. 013-2026/OECE-CD, in which the Board of Directors of the OECE unanimously approved Agreement No. 001-013-2026/OECE-CD to appoint Víctor Manuel Villanueva Sandoval to lead the TCP and to arrange for the formalization of the agreement via a resolution from the Executive Presidency.

The process was supported by the following internal documents of the body:

• Memorandum No. D000823-2026-OECE-GG, from the General Management, which attached the session minutes.
• Report No. D000538-2026-OECE-OAJ, from the Legal Advisory Office, which declared it legally viable to proceed with the formalization.
• Memorandum No. D000839-2026-OECE-GG, which adopted the report and submitted the draft resolution.

The resolution bears the approvals of the Acting Head of the Legal Advisory Office and the General Manager, and is signed by Karla Mónica Gaviño Masías, Executive President of the OECE.

What is the Public Procurement Tribunal

The Public Procurement Tribunal is the resolving body of the OECE, with full autonomy and independence in the exercise of its functions and with national competence and scope. In administrative terms, it depends on the Executive Presidency of the body.

The OECE, in turn, is a specialized technical body attached to the Ministry of Economy and Finance, with public law legal personality, which constitutes a budget entity and enjoys technical, administrative, functional, economic, and financial autonomy.

Legal Basis of the Appointment

The regulation invokes paragraph 11.1 of article 11 of Law No. 32069, General Public Procurement Law, which defines the nature of the OECE; literal c) of paragraph 12.1 of article 12, which qualifies the TCP as a resolving body; and paragraph 17.3 of article 17, which establishes that the President of the Public Procurement Tribunal is appointed by the Board of Directors of the OECE.

Article 19 and literal d) of Article 10 of the Updated Integrated Text of the Regulations of Organization and Functions of the OECE, approved by Executive Presidency Resolution No. D000090-2025-OECE-PRE, are also cited, as well as Article 8 and literal h) of Article 9 of the Internal Regulations of the Board of Directors of the State Procurement Supervisory Agency (OSCE), now OECE, the approval of which was formalized through Resolution No. D000249-2023-OSCE-PRE.

Article 2 of the resolution provides for the publication of the regulation on the digital headquarters of the OECE (www.gob.pe/oece) on the same day as its publication in the Official Gazette El Peruano.

Impact for providers and public entities

The TCP resolves controversies arising in selection procedures and in the contractual execution of the State; therefore, the presidency of the collegiate body directly affects the deadlines and criteria with which claims from providers and public entities throughout the country are addressed. With the formalization of Agreement No. 001-013-2026/OECE-CD, the OECE closes the designation process and grants full tenure to the resolving body of the public procurement system, in force under the framework of Law No. 32069.
