The mayor of Carballo assumes jurisdiction over the license for the Lamastelle eco-healthy plant
Por FactBox Admin

The mayor of Carballo, José Daniel Pérez López, has assumed the competence to grant the building permit for the industrial warehouse that the company Hornos de Lamastelle S.A. plans to build in the Bértoa business park. The decision was adopted through resolution no. 2707/2026, dated September 28, and has just been made public in the Official Gazette of the Province of A Coruña no. 206, dated October 28, 2026, under official reference 2026/6900. With this assumption of competence, the Mayor’s Office withdraws from the Local Government Board the competence that had been delegated to resolve this specific case.
The announcement, framed within the Local Administration section, identifies the matter as “Project for the construction of an eco-healthy plant for the company Hornos de Lamastelle S.A. on Madeira Street E1 - Bértoa business park.” The procedure is processed under case number 2026/U022/000030 and the object of the license is the “Construction of an industrial warehouse intended for an eco-healthy plant in the Bértoa business park,” according to the designation contained in the agreement itself.
A warehouse for producing bakery products
The published text specifies that the basic project presented by the company is intended for a plant dedicated to the “production of bakery products.” The elements identified in the agreement are as follows:
- Promoter: the commercial company Hornos de Lamastelle S.A.
- Location: plot E1 of Madeira Street, in the Bértoa business park, municipality of Carballo
- Action: construction of an industrial warehouse intended for an eco-healthy plant
- Planned activity: production of bakery products
- Technical instrument: basic construction execution project
- Municipal file: 2026/U022/000030
The announcement does not specify the investment amount, execution deadlines, or the number of jobs, data which do not appear in the assumption of competence agreement.
Assumption of a delegated competence due to urgency
The resolution bases the decision on a previous delegation: the competence had been attributed to the Local Government Board by Mayor’s Office resolution no. 2944/2025, dated October 13. The Mayor’s Office now recovers that competence “for reasons of urgency,” according to the published text, and supports the operation under Article 10 of Law 40/2015, of October 1, on the legal regime of the public sector, the regulation that governs the assumption of delegated competences.
The first point of the resolution part literally records the decision to “assume, for the resolution of this matter, the competence delegated by Mayor’s Office decree number 2944 of 13/10/2025 to the Local Government Board.” This is, therefore, a punctual reassignment of the body that signs the license, not a stable modification of the delegations in force in the council.
Publicity and subsequent control
The resolution adopted on September 28 does not end with its publication in the provincial bulletin: the agreement establishes two additional internal transparency obligations.
- Report the assumption of competence (avocación) to the Local Government Board at the first session held after the signature.
- Publish the resolution in the Official Gazette of the Province of A Coruña, as effectively occurs in issue 206 on October 28.
- Resolve file 2026/U022/000030 from the Mayor’s Office itself, without passing through the collegiate body.
The resolution is signed in Carballo on October 22, 2026, by the mayor’s office, and the announcement closes with reference 2026/6900.
The news is of direct interest to Bergantiños because it represents an administrative step in an industrial investment of significant scale: a plant linked to the baking sector that will be installed on a plot in the Bértoa industrial estate. The assumption of competence also allows for measuring the pace of the procedure, as it concentrates the decision on a license—which is usually resolved by the Local Government Board—in the figure of the mayor.
