New Performing Arts counselor takes office following resignation of circus representative
Por FactBox Admin

The Ministry of Cultures, Arts and Heritage formalized the resignation of Freddy Alex Huerta Sierra and the appointment of Nicolás Jaña Peña as the circus representative, in the capacity of circus trainer, before the National Council of Performing Arts. The decision is recorded in exempt resolution No. 2,945, issued in Valparaíso on October 5, 2026, and published in the Official Gazette No. 44,577 on Monday, October 19, 2026, in Section I (General Norms), with official reference CVE 2884334.
The administrative act was signed by the Undersecretary of Cultures and Arts, Carlos Lobos Mosqueira, exercising the faculty delegated through exempt resolution No. 75 of 2021 from the same ministry. The National Council of Performing Arts was created by article 3 of law No. 21,175, which establishes the National Fund for the Promotion and Development of Performing Arts, and its powers include advising the ministry on the formulation of the national strategic development policy for the performing arts.
According to the published text, the Council is composed of 16 members who serve two-year terms. Its composition includes, among others, two representatives of the circus: one who must be an artistic director or circus trainer, and another who must be a circus artist, pursuant to article 4 No. 4 of law No. 21,175 and article 6 of supreme decree No. 9 of 2020, which contains the Regulations for the Constitution of the Council.
The vacancy and the replacement
The resolution notes that the Asociación Gremial Red de Espacios de Circo A.G. was certified by the Executive Secretary (S) of Performing Arts as the most representative national entity of the circus sector. This status enabled the Executive Secretariat of Performing Arts to request the corresponding appointments in writing.
The immediate precedent is exempt resolution No. 1,532 of 2026 from the Undersecretariat of Cultures, which formalized the appointment of Freddy Alex Huerta Sierra as the circus representative in the capacity of circus trainer. For urgent reasons of good service, he assumed his duties on May 25, 2026, the date that act was issued.
On July 22, 2026, the council member submitted his resignation letter, which created the vacancy. The first article of the act formalizes that cessation effective as of that same date, and the second article formalizes the appointment of Nicolás Jaña Peña, proposed by the trade association, for the remaining period of his predecessor’s term.
Regional representation of Maule
The text highlights that the new counselor carries out his activities and actively collaborates in the Maule Region. This consistency is not incidental: the Fund’s regulations require the composition of the Council to be plural and balanced, with adequate representation of the regions and both sexes.
Specifically, at least eight of its members must carry out their activities in regions other than the Metropolitan Region, and this regional representation is mandatory regarding one of the persons referred to in numeral 4 of article 4 of Law No. 21.175, namely, the circus quota.
Probity, stipend, and processing
The fourth article provides that Nicolás Jaña Peña shall assume his functions from the date the resolution is issued, October 5, 2026, without waiting for its full processing. The fifth article specifies that, according to his sworn statement, he holds the status of a contract public official, therefore he will not receive a stipend or per diem as long as he maintains that status, pursuant to article 10 of Law No. 21.045.
The act also establishes obligations of conduct and transparency:
- Comply with the rules of probity and abstention in articles 52 and 53 of Law No. 18.575, article 12 of Law No. 19.880, and article 27 of Law No. 21.796.
- Submit the declaration of interests and assets, and for the Department of Personnel Management and Development to verify that Freddy Alex Huerta Sierra has fulfilled the same obligation following his resignation.
- Provide the appointee with a copy of exempt resolution No. 3.183 of 2025, which approves the instructional guide on probity rules.
- Notify both persons within five administrative business days via certified mail.
The resolution is exempt from the toma de razón (legal review) process by application of resolution No. 36 of 2024 from the Office of the Comptroller General of the Republic, and must only be sent to the registry of that body, entering through the single window according to article 14 No. 2 of resolution No. 7 of 2025. Once processed, it will be published on the ministry’s Transparent Government website, under the “Collegiate Bodies” typology, omitting identity cards and addresses in accordance with Law No. 19.628.
The replacement ensures the quorum and the sectoral representation of the circus in the body that guides public spending on performing arts, and confirms that the Council’s mandatory regional quota is covered from Maule for the remainder of the original term.
