Nine days to file an appeal against the firefighter competitive examinations
Por FactBox Admin

The Administrative Litigation Court No. 1 of Cáceres has summoned potential interested parties to appear in the appeal filed by a candidate against the review of the grade for the fourth test of the selection process for 73 Firefighter Driver positions for the Provincial Council of Cáceres. The summons, issued in ordinary procedure 202/2026, is published in the Official Gazette of the Province of Cáceres (BOP) No. 211, dated November 4, 2026, with a deadline of nine days starting from the day following its publication.
The announcement is signed by the Provincial Council of Cáceres, thereby complying with the requirement made by the judicial body, and is dated October 29, 2026, signed by the Chief Clerk, Álvaro Casas Avilés. The resolution is published in Section I, Local Administration, of the provincial gazette, on page 24797, with the official reference BOP-2026-5128.
The chain of decisions leading to the court
The litigation originates from the review of the grade for exercise number 2 corresponding to the fourth test of the selection process called to fill 73 Firefighter Driver positions. The previous administrative path is as follows:
- March 30, 2026: agreement of the Selection Board regarding the review of the grade for that exercise.
- July 14, 2026: resolution of the President of the Provincial Council of Cáceres dismissing the administrative appeal filed against said agreement.
- Administrative litigation appeal: filed at the request of Mr. Víctor Manuel Pavón Guillén against that dismissive resolution.
- Ordinary procedure 202/2026: number assigned to the appeal before the Administrative Litigation Court No. 1 of Cáceres.
The object of the appeal is, therefore, the administrative decision that confirmed the grade awarded in the fourth test of the process, and not the selection procedure as a whole, which affects 73 positions in the Firefighter Driver category.
Nine days to appear before the court
The summons is addressed to those who may have the status of interested parties in the procedure, meaning the candidates who could be affected by the judicial resolution that will be issued in due course. The deadline is nine days from the day following the publication of the announcement in the provincial gazette, and the appearance must be made before the Administrative Litigation Court No. 1 of Cáceres.
The Council bases the summons on Article 49 of the Law Regulating Administrative Litigation Jurisdiction, which mandates the public notification of the filing of the appeal so that third parties with a legitimate interest may appear if it serves their legal interests.
What happens if an interested party does not appear
The announcement establishes two consequences for those who do not appear within the deadline. The first is that, if the appearance occurs after the nine days, the interested party will be considered a party only for the non-precluded proceedings—that is, for the procedural actions whose deadlines have not yet closed.
The second is that, in the event of failing to appear in a timely manner, the procedure will continue through its stages without any notification being issued to that interested party, neither via court notice (en estrados) nor in any other form. The official text specifies that notifications of any kind will not be carried out in that case.
Impact for applicants
The publication affects a selection process for 73 positions; therefore, any applicant who could benefit or be harmed by an eventual granting of the appeal has a direct interest in appearing. The judicial resolution issued regarding the review of the grading of the fourth test could alter the result of the exercise and, consequently, the final order of the process.
Appearance within the nine-day period is, therefore, the only way for interested parties other than the appellant to defend their position in the proceedings and receive judicial notifications. The count begins the day following the publication of this announcement in the Official Gazette of the Province of Cáceres, meaning the margin is especially short for those who learn of the news through means other than direct consultation of the gazette.
