New trademark applications open for opposition before the SPTO

The Official Gazette of Industrial Property (BOPI), published by the Spanish Patent and Trademark Office (OEPM), publishes this September 8, 2026, dozens of trademark registration applications, including a collective mark from the Association Organization of Deep-Sea Fishing Producers of Cantabria (OPECA) and twelve applications from OLEA Drinks, S.L., from Lleida. The publication opens a two-month window for aggrieved third parties to file an opposition with the OEPM.

The BOPI, an autonomous body attached to the Ministry of Industry and Tourism, collects registration applications in its Volume I (Trademarks and other distinctive signs). Issue number 7233, year CXL, dated September 8, 2026, dedicates its trademark applications section starting from page 2, with dozens of files from companies and individuals across Spain.

A collective mark for Cantabrian deep-sea fishing

The Association Organization of Deep-Sea Fishing Producers of Cantabria (OPECA), headquartered in the Santander Fish Market Building, requests the registration of a collective mark (file M 4390782, filed on July 8, 2026, reference CVE-BOPI-T1-20260908-00000064). The mark, in PANTONE 293 C, black, and corporate gold colors, covers products in class 29:

• Fish landed at the Santander Market caught with trawling and fly gear.
• Non-living mollusks, non-living cephalopods, non-living crustaceans, and non-living shellfish landed at the Santander Market with the same gear.

OLEA Drinks registers twelve trademarks from Lleida

OLEA Drinks, S.L., located at avenida Blondel 11 in Lleida, submits twelve trademark applications (files M 4391238, M 4391243, M 4391258, M 4391265, M 4391270, M 4391291, M 4391300, M 4391306, M 4391312, M 4391319, M 4391322, and M 4391346), all filed on July 10, 2026, and processed by the agent Merx Patentes y Marcas, SLP, from Madrid. Most cover alcoholic beverages in class 33, with liqueurs made from agave spirits protected by the protected geographical indication Tequila, in addition to other classes:

• Class 33: alcoholic beverages, except beers.
• Class 25: clothing, footwear, and headgear (file M 4391258).
• Class 42: design and development of hardware and software (file M 4391312).

Two-month period for opposition

The publication of these applications in the BOPI begins the countdown of the two-month period for any third party who considers themselves aggrieved to file an opposition with the OEPM. The procedure particularly affects companies in the fishing and beverage sectors, as well as the industrial property agents representing the applicants.

The opening of these files reinforces the industrial property registry activity in Spain and obliges the holders of prior trademarks to monitor the BOPI to defend their rights, as silence during the opposition period may consolidate registrations that conflict with existing signs.
