The Plenary of the Council of the Judiciary assigned the duties of Provincial Prosecutor of Azuay to attorney Nube Ximena Rojas Castro, through Resolution 178-2026, approved unanimously in Extraordinary Session No. 125-2026 on August 31, 2026. The decision was published in the Second Supplement No. 366 of the Official Registry, from Quito, on Thursday, September 10, 2026, on page 35.

The resolution, signed by the president of the Council, Dr. Mercedes Johanna Caicedo Aldaz, PhD, and by members Magaly Camila Ruiz Cajas, Alfredo Juvenal Cuadros Añazco, Damián Alberto Larco Guamán, and Fabián Plinio Fabara Gallardo, nullifies the previous assignment and designates the new head of the provincial prosecutor’s office.

A change in the Azuay Prosecutor’s Office

The Plenary resolved, first of all, to terminate the assignment of duties of attorney Marcos Enrique Flores Calle, who had been serving as Provincial Prosecutor of Azuay since February 2026. In his place, Article 2 of the resolution provides for the assignment of those duties to attorney Nube Ximena Rojas Castro.

The change was processed at the request of the Attorney General’s Office, which through Official Letter No. FGE-DSP-2026-008436-O and Technical Report No. FGE-DTH-2026-00333, both dated August 26, 2026, requested the termination of the assignment and its allocation to another prosecutorial servant. The procedure included technical and legal reports from the National Directorate of Human Talent and the National Directorate of Legal Advice of the Council.

The decision is based on the powers that the Organic Code of the Judicial Function confers upon the Plenary of the Council of the Judiciary, in particular:

  • Paragraph 1 of Article 264, which empowers it to appoint district prosecutors and fiscal agents.
  • Paragraph 10 of the same article, relating to the issuance of internal regime resolutions.
  • Article 127 of the Organic Law of Public Service, which regulates the assignment of a vacant position by order of a competent authority.

The resolution shall enter into force upon its approval, without prejudice to its publication in the Official Registry and on the institutional website. The Attorney General’s Office must immediately execute the administrative and financial actions necessary to comply with the resolution.

Impact on the administration of justice

The assignment of the Provincial Prosecutor’s Office of Azuay, based in the city of Cuenca, has direct relevance to the administration of criminal justice in the province, as the Prosecutor’s Office directs the pre-procedural and procedural investigation of public criminal action offenses. The appointment of Nube Ximena Rojas Castro ensures the continuity of the prosecutorial service in the province and reinforces the decentralization of the Attorney General’s Office, an autonomous body of the Judicial Branch.
