Notification of a contentious appeal against the awarding of pharmacies in Alcúdia and Can Picafort

The Official Gazette of the Balearic Islands (BOIB) publishes in edict 9588 of issue 121, dated September 26, 2026, the notification and summons within the deadline for the parties interested in the contentious-administrative appeal PO 549/2026. The appeal was filed by María Paz Antonia Eleta Narváez against the Resolution of the Health Councilor, dated June 23, 2026, which dismissed her administrative appeal. The object of the litigation is the awarding of the pharmacy offices of Alcúdia 4 and Can Picafort, approved by resolutions of the Director General of Benefits, Pharmacy and Consumption on February 20, 2026.

The deadline to appear

The announcement was issued in compliance with article 49 of Law 29/1998, of July 13, regulating the contentious-administrative jurisdiction, and summons the parties interested in the ordinary procedure PO 549/2026 so that they may appear as defendants before the Contentious-Administrative Chamber of the High Court of Justice of the Balearic Islands (TSJIB).

• Deadline: nine days counting from the day after publication in the BOIB.
• Form of appearance: through a court representative (procurador) with power of attorney for this purpose and the signature of a lawyer.
• Effects of late appearance: anyone appearing after the deadline will be considered a party, without reversing or interrupting the procedure.
• Effects of non-appearance: the procedure will continue in all its steps and no further notification will be made to those who do not appear.

The announcement is signed by the Director General of Benefits, Pharmacy and Consumption, Juan Simonet Borrás, in Palma, on the date of the electronic signature, September 23, 2026.

The contested competitions

The litigation affects two competitions for the awarding of pharmacy offices, both resolved on February 20, 2026, by the Director General of Benefits, Pharmacy and Consumption, who approved the successful bidder and the final list of merits of the participants.

• Alcúdia 4: pharmacy office of the pharmaceutical zone of Alcúdia, within the perimeter formed by District 3 (sections 1a and 2a) and District 4 (sections 1a and 2a) of the municipality of Alcúdia.
• Can Picafort: pharmacy office of the pharmaceutical zone of Muro, within the perimeter of the urban land of the Can Picafort nucleus, in the municipality of Santa Margalida.
• Call for competitions: resolutions of the Director General of February 13 and 15, 2024, respectively, published in BOIB no. 24, of February 17.

The immediate judicial precedent

The filing of the appeal had already been announced two days prior. BOIB no. 120, of September 24, 2026, published edict 9531 from the Administrative Litigation Chamber of the TSJIB, reporting the appeal filed by the procurator Alberto Vall Cava de Llano on behalf of María Paz Antonia Eleta Narváez against the Department of Health of the Government of the Balearic Islands.

That announcement responded to the ordering diligence of September 21, 2026, and article 47.1 of Law 29/1998, with procedure identification number N.I.G. 07040 33 3 2026 0000484, under the subject of health and public health, and with administrative file SG/SJ 81/2026. The publication was signed by the Administration of Justice lawyer Paula Cristina Juan Salva.

Impact on users and professionals

The resolution of the dispute could alter the ownership of two pharmacy offices in areas of high seasonal pressure, such as Alcúdia and the center of Can Picafort, which directly affects the pharmacists involved and the users who depend on these establishments.
