New prescribed forms update tenancy rights and rent-setting notices

The Minister has issued S.I. No. 470 of 2026, the Residential Tenancies Act 2004 (Prescribed Form) (No. 3) Regulations 2026, published in Iris Oifigiúil on Tuesday, 15 September 2026. The Regulations substitute, with effect from 14 September 2026, Parts 2, 4, 5 and 6 of the Schedule to the Residential Tenancies Act 2004 (Prescribed Form) Regulations 2026 (S.I. 68 of 2026). They prescribe the documents and notices required for the purposes of the Residential Tenancies Act 2004 relating to information on tenancy rights and obligations and to notices concerning rent setting.

Scope of the substitution

The instrument is the third set of prescribed-form regulations issued under the 2004 Act, hence its “(No. 3)” designation. It replaces the earlier schedule adopted in S.I. 68 of 2026, updating the forms that landlords, tenants and the Residential Tenancies Board (RTB) must use in day-to-day tenancy administration.

The four substituted parts cover the core procedural documents of the tenancy lifecycle:

• Part 2 — documents setting out information on tenancy rights and obligations;
• Part 4 — notices relating to rent setting;
• Part 5 — further rent-related notices;
• Part 6 — associated prescribed forms under the 2004 Act.

Who is affected

The new forms apply across the private rented sector, touching every party that interacts with the tenancy framework established by the Residential Tenancies Act 2004. Landlords must use the updated documents when informing tenants of their rights and obligations and when serving rent-setting notices, while tenants rely on the same forms to understand and exercise their statutory protections.

The Residential Tenancies Board, which administers tenancy registration, dispute resolution and rent-setting procedures under the Act, will process submissions made on the newly prescribed forms. Because the substitution takes effect from 14 September 2026, any document issued on or after that date must conform to the revised schedule.
