Por FactBox Admin

The General Directorate of Labor of the Community of Madrid has ordered the publication of a final sanction of 49,181.00 euros against Ibarrola Multiservis, S. L. for a very serious infringement regarding occupational risk prevention. The decision is contained in the Resolution of October 6, 2026, disseminated in the BOCM no. 249 of October 19, 2026 (reference BOCM-20261019-30), once the sanction became final on September 25, 2026.
The publication is supported by article 40.2 of the revised text of the Law on Infringements and Sanctions in the Social Order, approved by Royal Legislative Decree 5/2000, of August 4, which mandates the publicity of sanctions for very serious infringements once they are final, and by Royal Decree 597/2007, of May 4, which determines the form of said publicity. The competent body is the General Directorate of Labor of the Ministry of Economy, Finance and Employment, in accordance with Decree 51/1995, of May 25, Decree 230/2023, of September 6, and Decree 63/2026, of July 22. The resolution bears the signature of the Director General of Labor, Silvia Marina Parra Rudilla.
Work near deteriorated fiber cement sheets
The sanctioned event occurred during the performance of work in proximity to a roof composed of fiber cement sheets with cracks, breaks, and holes, capable of releasing fibers into the environment. According to the account in the resolution, the company did not previously verify the safety of the space through the corresponding measurements.
The conduct is classified as a very serious infringement under article 13.10 of Royal Legislative Decree 5/2000, a provision that punishes omissions in health and safety matters that generate a serious risk for workers. The resolution does not impose an amount higher than the legal minimum provided for this type of infringement.

Five years of publicity and a precedent in September
Pursuant to article 4.2 of Royal Decree 597/2007, the data corresponding to the sanctioning resolution will be deleted five years from the day following its publication. The announcement is inserted in section I.D (Announcements) of the bulletin, on page 146.
The publication of this sanction is not an isolated case in the construction sector. The BOCM no. 216, of September 10, 2026, already included another resolution from the same general directorate, which publicized a sanction of 29,508.60 euros against Construcciones Rubau, S. A. for providing workers with a scaffold that had deficiencies, posing a serious and imminent risk of overturning, collapse, or cave-in. In that case, the company availed itself of the reduction under article 14.6 of Royal Decree 928/1998, of May 14.
Why it matters
The nominal dissemination of the sanction exposes the company to clients, subcontractors, and public tenders for five years, and places the focus on one of the least visible risks on a construction site: the handling of fiber cement roofing in poor condition, whose fibers can be released into the environment if the safety of the space is not measured beforehand. For workers in the sector, the announcement confirms that the omission of these prior measurements is punished in the highest bracket of the labor sanctioning regime, regardless of whether an accident occurred.
