Fine of 29,508 euros for Rubau due to scaffolding with risk of collapse

The General Directorate of Labor of the Community of Madrid has ordered the publication of the final sanction of 29,508.60 euros imposed on Construcciones Rubau, S. A. for a very serious infringement regarding occupational risk prevention. The resolution, signed on August 31, 2026, is published in the Official Gazette of the Community of Madrid number 216, dated September 10, 2026, page 38.

The company, dedicated to the construction of residential buildings, provided its workers with scaffolding that had deficiencies presenting a serious and imminent risk of overturning, collapse, or cave-in during its use. The infringement is classified under article 13.10 of the consolidated text of the Law on Infringements and Sanctions in the Social Order, approved by Royal Legislative Decree 5/2000, of August 4.

Regulatory framework of the publication

The publication of this sanction is supported by article 40.2 of the consolidated text of the Law on Infringements and Sanctions in the Social Order, which mandates that sanctions imposed for very serious infringements be made public once they are final. The regulatory development of this precept is contained in Royal Decree 597/2007, of May 4, regarding the publication of sanctions for very serious infringements in matters of occupational risk prevention.

The competence to execute labor legislation corresponds to the Community of Madrid by virtue of article 149.1.7.º of the Spanish Constitution. The resolution is issued in accordance with Decree 63/2026, of July 22, which regulates the publicity of sanctions for very serious infringements in this matter.

The final sanction reinforces the oversight of safety conditions in the construction sector, one of the areas with the highest rate of occupational accidents. The publication of these resolutions seeks to deter companies from failing to comply with risk prevention regulations and to guarantee transparency for workers and the public.
