MTC grants TIAN Telecomunicaciones a unique national concession for twenty years

MTC otorga a TIAN Telecomunicaciones concesión única nacional por veinte años

The Ministry of Transport and Communications (MTC) granted the company TIAN TELECOMUNICACIONES S.A.C. the Unique Concession for the provision of public telecommunications services throughout the territory of the Republic of Peru. The decision was adopted through Ministerial Resolution No. 487-2026-MTC/01.03, signed in Lima on September 11, 2026, and published in the Official Gazette El Peruano on Sunday, September 13, 2026.

The concession is granted for a term of twenty (20) years and enables the company to operate as a concessionaire of public telecommunications services nationwide, expanding competition in the sector. The resolution was signed by Minister Rafael Rey Rey, head of the Transport and Communications sector.

Scope of the Concession

The Unique Concession grants TIAN TELECOMUNICACIONES S.A.C. the status of concessionaire for the provision of public telecommunications services established by law. As the first services to be provided, the company declared the following:

  • Local carrier service, in switched mode.
  • Public cable broadcasting distribution service, in wired or optical cable mode.

If the concessionaire wishes to provide additional services, it must comply with the provisions of Article 155 of the Single Ordered Text of the General Regulations of the Telecommunications Law and request the MTC to register said services in the registry enabled for such purpose.

Regulatory Framework and Procedure

The application was submitted via registration document No. T-245948-2026. The granting is based on the Single Ordered Text of the Telecommunications Law, approved by Supreme Decree No. 013-93-TCC and its amendment, as well as the Single Ordered Text of the General Regulations of the Telecommunications Law, approved by Supreme Decree No. 020-2007-MTC.

The procedure received a favorable opinion from the General Directorate of Communications Programs and Projects and the approval of the Vice-Ministerial Office of Communications, in addition to the pronouncement of the General Office of Legal Counsel, which considered the granting to be legally viable.

Contract and Conditions

The resolution approves the Unique Concession Contract to be entered into with TIAN TELECOMUNICACIONES S.A.C., which consists of twenty-eight (28) clauses. The Director General of the General Directorate of Communications Programs and Projects is authorized to sign the contract on behalf of the MTC, as well as the public deed and any addenda.

The concession shall be null and void by operation of law if the contract is not signed by the company within a maximum period of sixty (60) business days computed from the publication of the resolution. For the signing, the concessionaire must first comply with the payment of the concession fee. A copy of the resolution will be sent to the General Directorate of Inspections and Sanctions in Communications for their knowledge and purposes.

Impact on the sector

The entry of TIAN TELECOMUNICACIONES S.A.C. as a new sole concessionaire reinforces competition in the Peruvian telecommunications market, by adding an operator enabled to provide carrier services and cable broadcasting distribution services throughout the national territory. The measure is part of the MTC policy to expand the service offering and favor citizens’ access to communications infrastructure in the country.
